The aim of this paper is to look at the ethical, moral, and legal challenges of impending dual relationships as an advocate or mediator. An individual point of view on the incorporation of advocacy and mediation within Human Service fields will be offered. A discovery of an individual thinking, and personal method to mediating and advocating inside an organization known as MHC (Mental Health Center).
Duel Association Challenges
A negotiator is an unprejudiced moderator who interacts with multiple parties to support and assist in mediation so as to reach agreement in the occurrence of conflict. The negotiator is not a conclusion architect, but a tool used towards resolution in the conflict. The ultimate resolution is made by the parties in conflict. “It is the legal and ethical job of the mediator to keep all communication confidential unless otherwise specified” (AAM, 2008).
For a practicing mediator remaining impartial is important when mediating with parties in disagreement. This task can be challenging due to personal values, ideals, ethics and principles although is necessary to maintain the veracity of the mediation method. Mediators encounter lawful, ethical, and principled concerns on when working as the go-between in conflicts nevertheless must maintain neutrality to circumvent potential troubles inside the mediation. In mediation, when any concerned party in conflict believes the mediator has been biased those parties are obliged to search for mediation services from another conciliator.
Advocates and mediators are especially vital in the Human Service field since clients are frequently inexpert in understanding their civil liberties and rights that subsist in our government. Further still, many individuals receiving assistance of Human Service organizations, are regularly naive to the laws that guard them, subsequently advocates and mediators are indispensable in educating clients of these rights and laws. Mediators are central in the Human Services particularly because they are a means of statement, message and “give and take” amid parties in conflict. Without these means and a dais then marginal factions are habitually living discontented lifestyles since their individual and group civil liberties and freedoms are going on unmet.
Individual Viewpoint and Method
As a Human Service worker providing advocacy for clients MHC (Mental Health Center) there is an importance that the client believe in the advocacy service presented. Facilitating, in unbiased manner, for clients it would be imperative that the Human Service worker hold no conflicts of interest with individuals seeking advocacy services from the organization. “The Mental Health Center educates clients throughout the advocacy, and helps build communities of well-being by providing clients strong advocacy services”, MHC, 2010). At MHC, one of their many programs is Community Based Case Management, in this program the advocate/mediator, advocates for services and supports directed toward the achievement of the client’s goals for community living. Although the focus of advocate and client is for the client, whom is mentally ill, to attain recovery and self-managed life. In this, the mediator should not influence the client or make decisions for the client, the process involves making possible communication for a positive outcome that the client and other entity can agree on.
While the advocate may be passionate and the mediator be committed both must remain neutral if they really want to help clients through difficult tribulations. Advocates must aid in attaining needed services and resources and mediators should continue on in assistance to help the client and other interested parties come to a educated and fair decisions about resolution. If a Human Service advocate/mediator does not agree with clients conflicts or seeking of advocacy for any circumstances then they should not work for this or any other service that works with mentally ill.
