How Siddhartha, the prince of Kapilavastu, became Buddha, the "Enlightened One".

Read Life Story of Buddha in Pictures: Part 1

Siddhartha the prince began to live like an ascetic and, like them, began to beg for food, and moved from place to place, never staying in one place for long.

Siddhartha initially went to Rajgir (part of Magadha kingdom in today’s Indian State of Bihar). King Bimbisara of Magadha learned of this wandering ascetic and invited him to the palace. He knew of Siddhartha’s parentage, and offered him half his kingdom. Siddhartha rejected the offer, but promised to visit his kingdom when he became successful in his mission.

Siddhartha left Rajgir and began seeking out renowned teachers, who taught him about the many religious philosophies of his day as well as how to meditate. After mastering the teachings of Arada Kalama, he went on to become a student of Udraka Rāmaputra. But after he had learned all they had to teach, his doubts and questions remained. He moved on.

By now Siddhartha had five companions who were on a similar quest as him. They tried to find enlightenment and release from suffering through physical discipline—enduring pain, holding their breath, and fasting nearly to starvation.

One day, he collapsed in a river while bathing, and almost drowned. Realizing that extreme asceticism didn’t work, he began to reconsider his path. He then accepted milk and rice pudding from a village girl named Sujata.

The five companions, believing that he had abandoned his search and become undisciplined, left.

Gautama (another name for Siddhartha) then seated himself under a pipal (Ficus religiosa) tree—now known as the Bodhi tree—in Bodh Gaya, India, and vowed never to arise until he had found the truth. After a reputed 49 days of meditation, at the age of 35, he is said to have attained Enlightenment. He had discovered what Buddhists call the Middle Way—a path of moderation, away from the extremes of self-indulgence and self-mortification.

Siddhartha, now called Buddha, realized complete insight into the cause of suffering, and ways to eliminate it. These discoveries became known as the “Four Noble Truths“, which are at the heart of Buddhist teaching. By mastering these truths, anybody can attain Nirvana, a state of supreme liberation and a perfect peace of a mind, free from ignorance, greed and hatred.

Buddha devoted himself to teaching, attracting hundreds of followers. At first, he was reluctant to teach, because what he had realized could not be communicated in words. Listeners without that direct experience would be stuck in conceptualizations and would surely misunderstand everything he said. But compassion persuaded him to make the attempt.

After his enlightenment, he went to the Deer Park in Isipatana (today’s Sarnath in Uttar Pradesh). There he found the five companions who had abandoned him, and he taught them a path of practice centered on the Four Noble Truths to realize enlightenment for themselves.

He also converted Emperor Bimbisara to Buddhism at the Griddhakoota Hill in Rajgir.

Eventually he became reconciled with his father, King Suddhodana. His wife, the devoted Yasodhara, became a nun and a disciple.

Rahula, his son, became a novice monk at the age of 7 and spent the rest of his life with his father.

In the next set of articles, we will visit places connected with Buddha’s life.

Buddha's birth, his early years as a prince, his marriage...

How Siddhartha, the prince of Kapilavastu across the foothills of the Himalayas, became Buddha, the ‘awakened one’, is an interesting story. Ordinary people live life as in a dream. Enlightenment is like waking up and experiencing a complete transformation of body and mind. Siddhartha transcended from the pain of suffering and rebirth to Nirvana and experienced a sense of peace and a unique form of awareness or intelligence that is called bodhi in Buddhism.

*******

Queen Mahamaya caressed her belly fondly. She thought of the vivid dream she had the previous night – a full moon night. She felt herself being carried away by four celestials to Lake Anotatta (Pali word for Lake Mansarovar in today’s Tibet) in the Himalayas, bathing, dressing and anointing her. Soon after, a white elephant, holding a white lotus flower in its trunk, appeared and went round her three times, entering her womb through her right side.

The queen awoke with a start. The dream, she knew, was very symbolic and portended something momentous to happen in her life. When her husband, King Shuddhodana, heard this, he sent for some wise men to discover the meaning of the dream.

“The gods have chosen our queen as the mother of the Purest-One and the child will be a great human being,” said the wise men.

There was a great jubilation all around.

As per the prevailing custom, the queen wanted to go to her parent’s home for delivery. She expressed her desire to Shuddhodana. The king made all the arrangements for the queen to visit her father’s kingdom in Lumbini in Nepal.

The journey was long and tiring. And then the pains began.

Queen Mahamaya moved to a grove along with her retinue. With her maids’ assistance, she stood holding on to the branch of a sal tree and delivered the child from her side. The year was 583 BCE. A gentle rain fell on the mother and the child to cleanse them.

The child was named Siddhartha, which means “he who has attained his goals.”

Sadly, Mahamaya died only seven days after Siddhartha’s birth. After that Siddhartha was raised by his mother’s kind sister, Mahaprajapati.

Asita, a well-known sooth-sayer in Shuddhodhana’s kingdom, prophesied that Siddhartha would be a great emperor or a great sage and a savior of humanity.

The thought that his son could become a sage made the king very anxious. He wanted Siddhartha to carry on his own royal traditions.

To keep Siddhartha’s mind from other-worldly thoughts, the king did not permit him to move out of the palace or witness the miseries of poverty, sickness or old age.

Siddhartha grew up to be strong and well trained in the arts of war. At the age of 16, he married a beautiful princess called Yashodhara from the neighboring kingdom. In the course of time, a son called Rahul was born to them.

Life as prince: Source

The Prince reached the age of 29 with little experience of the world outside the walls of his opulent palaces.

One day, overcome with curiosity, Prince Siddhartha asked his charioteer Channa to take him on a ride through the countryside. On these journeys he was shocked by the sight of an aged man, then a sick man, and then a corpse. The stark realities of life sickened the Prince.

Finally, he saw a wandering ascetic. The charioteer explained that the ascetic was one who had renounced the world and sought release from fear of death and suffering.

One night he wandered the palace alone. The luxuries that had once pleased him now seemed distasteful. Prince Siddhartha reflected on the old age, disease, and death that would overtake them all and turn their bodies to dust.

He realized then that he could no longer be content living the life of a prince. That very night he took one last look at his sleeping wife and son.

With the help of Channa, he left the palace on his favorite horse Kanthaka, crossed the river Anoma. Then he gave all the ornaments, robes and other personal belongings to Channa and bade him return to the palace.

With the decision to live like a mendicant, Siddhartha shaved off his head.

Thus began Siddhartha’s quest for enlightenment. Siddhartha was 29 years old then.

We all have a job and we do it whether we like it or not. So why do we work? Most of us work for making money to meet the basic human needs and to live with more comforts and higher standard of living. But how many of us love our work? How important is to love the work we do? How important is to respect your work? Please read on…….

What are you working for? Most commonly people work for making a living. Some may work for fame and money. A very few may work for fame alone. Most of us work for Friday evenings. We all are eagerly looking forward to the weekends. Why do we think we are happy on weekends? It’s because we don’t love our jobs. Those who don’t love their jobs only can feel the work boring.

Cover of Work With Passion

Can you do your work without desires? Everyone is working to make money and live comfortably, isn’t it? However the best way of working is working without bothering about the results. It’s easier saying than practicing. If you can work without giving importance to the monetary benefits, all other things fall into place. In other words, if you work hard with passion without bothering about the results, you will get financial success and spiritual success automatically.

How to achieve it: If writing is your job, you should write with passion and complete involvement without worrying about the results. You may write quality articles and may not get the page views you deserve at Triond. The comments you get may not be satisfying. It may take years for you to make it to the Hot Content or you may never make it to the Hot Content. You may not be able to make decent money from your quality writing. Yet, you should not worry about the poor results and keep on doing your work with love and total involvement. Alternatively if your crappy articles get into Hot Content, you should not get carried away by it. In short success and failures should not affect you and you have to keep on doing your work with passion and love.

Image via Wikipedia

Worshipping God: You all will agree with me that it’s good to worship God. Bhagavad Gita says we should worship God all the time, not just once in a week or on special occasions. But how can we worship God all the time? Is it practical? Work is God and if work with devotion it’s equivalent to worshipping God. Whatever work you do with total involvement and concentration is Yoga. If Sachin Tendulkar is batting with tremendous concentration and passion, batting is yoga to him. Singing, dancing can be yoga too if done with

Summary: Work is very important for each one of us. Work is equal to God. It’s good if we could worship God all the time but it’s not practically possible in this fast world as we have to spend a lot of time in our work.
The idea that we can live after death as another person--maybe a famous singer or be born in a different country--is intriguing and, for me the idea is not only highly appealing, the idea is freaking awesome. Do you think that you may have lived a past life? Do you believe in Karma, spiritual lessons and the fact that you can be born again?

There are people who don’t believe in past lives, karma and reincarnation. But we should be more open-minded. There is so much information about the universe, about our minds, that is so mysterious to comprehend. Is there any truth to it? Is this just an idea to stop feeling scared about the after life? A fantasy? Or is there real evidence?

Small Children And Past Lives

Believe it or not, kids don’t make up stuff. For example, highly respected scientists, investigators and researchers studied millions of memories of young children between the age of 3-9, who had vivid memories of previous lives, and spoke about past lives in great detail.

Hypnosis and regression therapy

Hypnosis has never been a valuable tool to find out about past lives. Hypnosis can reach the unconscious mind, but it’s believed that the information kept there by our brains is not real. It has been discovered that the hypnosis can create false memories. That doesn’t mean, however, that this technique should be discarded. If the past life information given by the person under hypnosis can be verified by doing some research, their stories can be considered more serious if there’s some evidence to back up their claims.

Deja Vu or Spontaneous Recall

It’s hard to explain to others that you get the feeling that you’ve been somewhere before. There are all sorts of experiences and many people tend to believe they are real–they’ve lived before in other bodies, cultures, and centuries.

Conclusion

Past life recall is one of the most bizarre cases of paranormal phenomena. As yet, we haven’t been able to prove or disprove the evidence. Many scientists are unsure whether the information given by some people was somehow given by the subconscious. Unfortunately, there is the possibility of fraud and it’s very important to be skeptical about claims, but the stories will always be fun to read and hear.

Tarot is the new-age science used for guidance, divination and healing.

Tarot is the new-age science used for guidance, divination and healing. The main purpose of Tarot is self-improvement,self-knowledge and meditation. It helps the querist to understand himself or herself and move in the right direction to fulfil her destiny.Carl Jung used these cards for psychotherapy, too. In fact Jung was the first psychoanalyst to attach importance to tarot symbolism. He might have regarded tarot cards as the representations of archetypes embedded in the collective unconscious of all human beings.

Tarot cards were used from the mid-15th century in various parts of Europe to play Italian tarocchini and French tarot – a group of card games. In the late 18th century the use of tarot by mystics and occultists began for the purpose of divination in order to trace mental and spiritual pathways.

The mythic tarot reading, developed by Liz Greene and Juliet Sharman-Burke in 1986 links tarot symbolism with the classical Greek myths.

Tarot comprises 78 pictorial cards which depict the whole gamut of human existence and experience. All that one encounters in life finds expression in the Tarot. Each card has several meanings, which further shift and change in combination with other cards.

The cards possess ancient symbols which connect with the subconscious mind and help it in creating external circumstances to match the images of the card.

To use the tarot cards for healing the mind and creating favorable circumstances, all you need is to take the recommended card for your sign for that year and meditate on it for 10 minutes every morning and night.

You could light an incense stick,or a candle or a ‘diya’ and focus your energies on the card.Try to understand what the card means, and what it is conveying.Feel the emotion that the card evokes and absorb its energy slowly. This way you will be able to build a relationship with the card and impress your subconscious mind with the message which it then makes a reality.

Hardly anyone knows it, and those who do fight, it most vehemently: long before the western commercial movement Feng Shui, China had (initially only in the southern part of present-day People's Republic and even there only in the coastal areas), the harmony and movement of life Sheng Fui.

The system philosophy as was first built by Sage Hsien Chen Yu was, is denoted by the symbols Sheng for the power of reason and wisdom and Fui, power and lust for love.

The genesis of the name-Sheng Fui reads like a thriller. The system philosophy as was first built by Sage Hsien Chen Yu was, is denoted by the symbols Sheng for the power of reason and wisdom and Fui, power and lust for love. When it comes to the westernization and therefore commercial exploitation of this system was probably the oldest known philosophy, has one – plenty of clumsy and unimaginative – merely the initial letters reversed: it was from the new Feng Shui Sheng Fui …

As much as this one at first harmless-sounding words like fake smile: the contents of this new heresy comes from a real danger.

Today Feng Shui is a collection of exaggerations and distortions, which result in the sum often the opposite of what they are intended.

The web-www.sheng fui.de wants to expose the dangerous errors of the Feng Shui cult and return to the core philosophy of the actual system, the pure and unadulterated Sheng Fui. On the informative pages you’ll find valuable information about the real and only true Sheng-Fui, which was proven in all world religions.

For the ancient Egyptians, the underworld was a place full of dangers and tests that they would need to pass in order to have a place in heaven.

Like with any other religion, the ancient Egyptian priests told people about legends and myths about the afterlife and the ancient Egyptians believed in their religion, followed it, and knew it by heart. They believed in many gods and goddesses, but that is not what is more intriguing to me. The ancient Egyptians believed that the soul was split up into many parts.

The ka was the person’s life force. In order for the deceased to be happy in the after life, it was required to leave food, drinks and many other enjoyable things inside the tombs.

The Ba was everything that made individuals unique–it was their personality. The ancient Egyptians thought that the soul would live after the body died, and this would take the form of a human-headed bird flying out of the tomb to meet with the ‘Ka’ in the afterlife.

The lb was also part of the soul. The lb was the person’s heart. The heart was the seat of all that was good and evil in everyone. The heart was the most important part of the body–the gods judged this part. It is important to note that to the Ancient Egyptians, it was not the brain the center of emotion, thought, intention and will. The heart was the key to the afterlife for this ancient religion. The heart gave evidence about the deceased. The god Anubis and other gods examined the heart during the weighing of the heart ceremony. If the heart weighed more than a feather, the deceased had no place in heaven–Ammit (monster) consumed the souls instead of sending them to hell–it was destroyed forever.

The Ren was the person’s name. It was believed that the name would live forever as long as the name was spoken. Many efforts were made to protect the name by placing it in numerous writings. To ensure the survival of your name, a magical rope often was used to surround the name and protect it from evil.

Sheut. This was a person’s shadow and always present. The ancient Egyptians believed that you could not exist in this world if you didn’t have a shadow, and a shadow could not exist without a person.

Why part of the soul? Not so sure. Your shadow is black, and the god Anubis was a black jackal perhaps that’s why they made the connection; Anubis protected the souls.

The last part of the soul was the Akh. The Akh was what made a dead person into a living one– It was a ghost and it was capable of helping or hurting family members.

Reincarnation is the accepting in the clearing of souls and reincarnation and birth, based on the ascertainment of annular aeon in nature. Talking about reincarnation and activation that we alive abounding lives, while conceivably not accomplishing airy maturity, ablution and enlightenment. Research shows that today, one division of European nations accept in reincarnation. In America and Canada, the statistics are higher, and the East is the reincarnation of the base of all religious beliefs, whether it be Hinduism, Buddhism or Taoism.

Although it is claimed that the abstraction of reincarnation came from the east (referred to the Upanishads in 8 aeon BC), in the West we additionally accept actual early, in all the cults of attributes and pre-Christian religions. It is argued that its accepting in the West accompanying with the all-embracing advance ezoterizma although he and his alone acknowledgment to the advance of consumerism and materialism total.

Proponents of reincarnation accept that casual through abounding lives (incarnations) is all-important for airy growth, ablution and final deliverance. In some means they are Christian affliction abode on the alluvial plane, and because the bulk of suffering, there is about and hell. In fact, according to this accepting in a way anybody creates his own hell. We canyon through adversity to purify, absolution the apparition and afterpiece to all-powerful perfection. K God can alone be absolutely antiseptic and aware souls.

Not anybody agrees about what is affective into fresh bodies and fresh birth. The better allotment of rinkarnacionista believes that it is the soul, some bodies anticipate it’s personality with the acquaintance gained, and some anticipate it is the animal spirit. I do not anticipate that reincarnation is a contemporary fad or abstruse fiction. This abstraction is as old as animal anticipation and the ancestry of his consciousness.

The Zero Point Energy Field, or The Unified Field unites and holds all Universal Life. ONE almighty force, like a web connects, binds and sustains everthing and everyone, all souls because all life is energy; ONE Energy.

Zero Point Energy Field

The Zero Point Energy Field (ZPEF) is similar to a web or matrix of energy, originating from God and it prevails throughout everything and everyone in the Universe – or multiple universes. It is infinite; indeterminable, without shape, has no sides or limitations of any type. Imagine a film or a page with the ZPEF as an all-encompassing overlay, and/or under-lay that superimposes everything, but is ever present without any limitations, borders, shape, etc.

Other writers like Aaron Murakami – author of The Quantum Key, among many other great pieces – refer to it as Aether; which bears the air we breathe. Or possibly the ZPEF also bears the Aether or visa-versa, which also bears everything else. These books are highly recommended.

‘The Quantum Key’ by Aaron Murakami asks the question, “Where, or on what, do you think the air, oxygen, actually exists?” This question blew me away because I automatically thought, as most of us do, that it is in the air. I mean, for Pete’s sake, just wave your arms around and feel the air. And then it dawned on me; WHAM. If this is the air that I am feeling on my hands and arms, then what holds the air in place; on what does it float; what keeps it in place? This is the Aether that Aaron Murakami teaches about in a small part of his vast writings. For more info on these writings go to – http://oneenergy.qiman.hop.clickbank.net.

Peace and harmony in ZPEF

So then; since everything comprises one life and one creation, all living within one great energy field, one would presume that we are all living one harmonious and peaceful life together; right?. Mmmmm. Afraid not.

This article is not intended to hammer mankind, but we need to acknowledge that we cause perpetual wars, power struggles, religious disharmony, and cultural conflicts. We eternally are trashing our planet through our luxurious lifestyle by way of industrial and electricity production, uranium waste which takes three hundred years to loose its radiation power, petrol driven vehicles and aircraft, space exploration, destroying our oceans through abuse and oil leakage, plastic production and waste, other poisonous substances and gases.

We have reduced the nutritional value of our natural foods through the abuse of and draining of agricultural land, destruction of ecosystems. Not to mention the ever shortening supply of water – our life-blood. And the poisonous water seeping upward from mine shafts and that is running into rivers and tributaries – poisoning everything on our planet.

We need say no more on this.

How to save our planet

The good news is that some means do exist whereby we can help save our planet, ourselves and especially future generations. Although we have created a no-cure situation for Mother Earth, it’s like being sucked into a vortex and there is no return. The follow-up articles which are listed below deal with means by which we can help to save our planet.

Mother Earth – Mother God?

Living as one with Mother Nature

We had an interactive moot court orientation program at the Institute of law, Nirma university. It was all very informative. The students who have won the international moot courts and one lawyer of the Gujarat High court spread knowledge among us which I would like to share with the world.

The Institute of law, Nirma university,Ahmedabad, Gujarat, India have organised an interactive moot court orientation program for its 1st year students of Law to make them aware about various etiquette, intricacies, and technicalities of this science called as Mooting or in a simpler way we can say debating or Arguing. But don’t think that mooting just means debating or arguing, Mooting is a lot more. It is science, and art and a technique needed to learn by every law student, to inculcate the litigation culture and to become the best lawyer, from the very first year of the 5 year law course. In debate and argue you simply argue to win the situation in any possible manner sometimes by shouting. But In mooting you need to argue to convince the judge with proper proofs, by keeping your voice humble, and by following the mooting culture and manners.

Mooting skills boosts up the confidence level of the student, so every law student should participate in moot court which is a fun with learning technique, which is ultimately going to give you fruits in future. Mooting requires lots of hard work and efforts with lots of knowledge, that can affect your marks but ultimately will give you an edge among all the other students. It will add value to your CV [that you prepare for fetching a job] and a lot of exposure comes to you. When you participate in International moot courts many companies see you and they decides that they can recruit you during placement, so that is another plus point. No one is a born mooter, this is a technique which every law students learns only after entering into a law school. The more you practice the better you perform.

Moot court is a dummy of original court where law students learn the art of mooting or lawyer-ing. The students are given framed cases on which they have to argue to win the case, that actually happens in real life situation and real courts. It looks like a real court where 3 judges will listen to you while you present your case, after you finish they start bombarding you with thousands of questions.

There is 2 mooters one is counsel and other is co counsel, and there are 2 researchers who should know all the relevant laws and cases related to the case. Mooter is a orator but the actual research is done by researcher. Researcher prepare the things to be presented after doing a lot of research work and mooter presents it before the judge.

History of moot court in India

The moot court culture first was adopted by Britain. India after Independence adopted many features of Britain, be it a language, constitution, cloths and what not.

In 997 there was one university Inns of court which was on the same footing with oxford, nalanda and Cambridge in terms of legal education. That was basically a law school. In 18th and 19th century formal legal education began in America where they followed the same practices of teaching as Inns courts, England. The professors followed the same method of teaching by mooting exercises. Then in 1870 Harvard introduced the case system, thus this was also introduced in mooting culture and the same culture is been followed by almost every college and universities providing legal education.

In India the mooting culture started when Bar council of India organised the Bar council of India moot court in the year 1981. In 1985 learning through moot court became an integrated feature of Indian legal education. And from that time, mooting culture is being followed by Indian law institutes.

Mooting manners

Dressing sense:- Avoid wearing informal dress, Moot court is a platform which will guide you to face business professionals in future and you are to present yourself in best possible manner before eminent jurists, so in order to be on a safer side wear formal dress [Black trouser, white shirt and black blasser]. It reflects that you have proper knowledge and understanding of the subject matter and you are more serious and well aware about your work. Boys should have short hair, so that you do not need to comb them with your hands during your 10-15 minutes mooting presentation. Girls should make a tight pony tail so that its hair should not fall in between the presentation.

Moot court add value to your CV and it invites a lot of exposure.Moot court is self test of confidence and personality. Thus everyone should participate in a moot court.

Never argue on the basis of the facts of the given case but argue on the basis of laws.

Start up with May it please your honour. Tell the facts to a judge like a story telling. Narrate your favorable points in a simple way. Hide your weak points of facts without suppressing any material facts. Don’t suggest any incorrect thing.Always respect the judge, as he is your god. What ever he is saying is right. Good behaviour toward all will make your way easy as questions can be asked just to check your patience. You should develop good command over speech therapy [including temper, language, gesture and movement of your body] Dressing should be adequate as explained above.

How to prepare

Read the facts of the cases twice minimum and 5 times maximum.

Underline the important things.

Prepare chronological sequence of events

After reading 4th time jot down points that comes to your mind. Jot down from both of the angles one from petitioner’s and other from the respondent’s. Don’t be overconfident, overconfidence will kill you. Always consider yourself a learner learning from others mistake. Be a master of facts, that can only be done by reading 3 to 4 times the facts of the case. Try to put yourself in opponent’s shoes and think like him. Always work in a group, you all will have different points which can be helpful in winning the situation. All people in a group should prepare favorable points for opposition as well and then prepare controversies. Find out where is the exact problem, then try to find out various provisions of law applicable to the given case, then connect the legal provisions to the points in your favour and also prepare defences against the points that opposition can raise with proper proof. Find out the citation of a court or similar judgement delivered by court. If there is no such judgement delivered by Supreme court then try to find out the judgement of High court, If not High court then Supreme court and if neither supreme court nor High court has delivered such judgements then try to cite the judgement by foreign superior courts and International court of justice.

You should prepare your brief after taking care it should be simple written submission. Always focus on your strongest points and try to hide the weakest points. Make your strong points more strong and find out the way from the weak points.

Training

Practice makes a man perfect but only perfect practice makes perfect. Don’t forget the small things while making the presentable submission as small things brings perfection and perfection itself is not a small thing. What to say and how to say is the only art to develop for mooting. Always keep separate documents ready for your oral submission as there is world of difference between what you submit manually and orally.

Always show the legal provisions after you finish your arguments, and never fight on facts fight on laws. Try to read in Between the lines. Explain to judge how such legal provision is applicable to the given facts and situation. Try to convince judge in a very humble and polite manner.

Research

Before you participate in any moot court competition, be sure to have read all the rules and regulation for the participants. The competition rules will give you a thorough guidelines and deadlines as well as the manner in which the memorial is to be prepared. Team work is indigenous part and is very essential. Read the entire moot problem with your team member thoroughly, also read various articles available on Internet related to the moot problem also read full laws that are applicable to such a situation. you can also cite the judgements delivered by superior courts on the matter familiar to your moot problem.

Be prepared with the points that can be raised by your opponent. A good mooter should know what an opponent wants to argue, so it is always better to scrutinize the case carefully and write the defences and facts and arguments in both of th parties behalf.

Research the law

First read the facts of the case then analyse the background of both of the parties, then find out the dispute between the parties and finally write about all these things. Look at any case mentioned in the problem.

Read articles related to the subject matter of the case, but again articles are only for clarifying your doubts, don’t refer or cite it before the judge and in the memorial refer only the cases and judgements as articles are merely an opinion of the author and thus you cannot fully rely upon it.

Points to remember

Have a research plan. Don’t take any shortcut for your research, the longer the way the better is the research but work smartly. while thinking as petitioner of one side think about the other side too. Stay focused about your objective about what do you want to prove and keep the authority in mind.

International mooting culture:-

Arbitration court is different from other court, Arbitration court is out of court settlement. Initiating a legal proceedings in a court is a time consuming process, it takes many years sometimes even centuries for court to resolve the matter so people find is better to get the matter solved before an arbitration court.

Arbitration moot court is very popular in foreign countries but in India only National law school of India universe -NLSIU Bangalore has such facility.

Like India have precedent, laws and statutes as sources, the sources of International law are International treaties [convention, protocol], customs, General principles and works of eminent jurists.

Terms:

Use Agent or prosecution for counsel

use your excellency for your honour.

compromise means moot court problem.

some strategic points:-

Be clear on the points of jurisdiction. Have wide knowledge of the contemporary issues similar to the moot problem.Cite international instruments like UN resolutions etc. Never forget to mention the citation in the written submission. Be particular about good behaviour as good court manners matters a lot. Jot down the issues on which you have to argue, it should be in your hand at the time of giving presentation so you need not waste your time in thinking what were the issues. Your main Issues can be 1 and can be maximum 4, but you can always divide it into sub issues.

Prepare summary of arguments which is a gist of arguments. Don’t use I use counsel example- counsel wants to present the facts of the case. Avoid saying thank you instead say Much obliged. In order to seek permission say your lord and not sir. Instead of saying yes say Indeed. make your arguments very clear don’t leave any point vague. If judges throws questions on you the stop as soon as judge start speaking then give answer to him to the point and if he asked something which you don’t know then avoid pleading ignorance instead ask them to enlighten you with the matter, it will leave a good impression that even though counsel don’t know whatever asked by the judges but it is interested in knowing it. If your points does not match with the points of judges then never say that you are wrong, learn to disagree humbly, say something like this my honour the counsel begs to differ and my point is this. Before starting anything, seek permission and then move forward.

So before taking part in any moot court competition be it domestic one or an international one, if you keep all these points in mind and work whole heartily then no one can stop you from winning the case.

Overall the moot court orientation session was very informative and interesting.
