Child Pornography, Sex Offenders and the Mess That is the Federal Prison System

Whats wrong with the Federal Prison system.

Nearly 2 YEARS later the FBI shows up at our door and presents him with all the conversations he had with this guy and that pictures that he received and sent.  He was then arrested and charged with possessing child porn and for trafficking child porn because he sent the email back to the guy that sent it to him over the state line. After having to spend nearly $10,000 on a lawyer and taking lie detector tests from the FBI and an FBI recommended polygraph expert (which he passed ALL questions) then went to another Dr that treats pedophiles and was cleared by this Dr that was recommended by the FBI and the Dr even wrote a letter to the judge telling him that he posed no threat to children nor would he ever and then having nearly 100 letters of support written and turned in to the judge.  He still got 5 YEARS in Federal Prison because that was the LEAST amount he could be sentenced to. 5 YEARS for doing NOTHING more than downloading a few pictures that he never even asked for to begin with.  And the whole thing came from the guy that chatted him up on line and sent him the pictures was a cop from New Jersey that took it upon himself to set up 25 people with the same pictures. 

My friend pleaded guilty because he had no choice.  3 of the others fought the charges with a jury and they were all found guilty and one got 22 YEARS one for 12 YEARS and the other got 18 YEARS for doing nothing more than downloading the same pictures and sending them back to the guy the only difference was that they all fought the charges but since they did they all got more than the mandatory minimum 5 years.

Just keep in mind that this can happen to ANYONE you know including YOU.

After he gets out of prison in 2012 he will have to register as a sex offender even though he NEVER was in contact with ANY child, NEVER had any plans to do that, passed all polygraph and psychotherapy tests they gave him showing he was not and was never a threat to society. THE LAWS NEED TO BE CHANGED.

There was one case i read about recently where a man was arrested for exposing himself to as many as 12 children over the course of 2 months. He got 6 MONTHS in jail.  Now can you tell me how that sentence is given, but someone that can merely look at a picture they get 5 YEARS. The system needs to be changed and congress needs to be aware that everyone should NOT be required to register as a sex offender. A sex offender should be for hands on crimes not for merely looking at a picture. If they have proof that a person did something to a child then by all means to the fullest extent of the law do something, but for someone who did nothing but look at a picture there should be a whole separate guideline for that. I mean its like you ran a stop sign and they give u the same sentence they give someone for vehicular homicide because you COULD have killed someone. Just like you downloaded a picture so u get a sentence like you raped a child.

They do ENTRAP people on line so beware.

    My brother is in a similar situation only his “crime” was for downloading using Kazaa. It was never proven who did download this heinous material but there was evidence that his wife did it and blamed it on him. The feds were not interested in that. They picked out the easiest one to convict and started building their case around him. The entire case was circumstantial but he was convicted and given 9 years in prison and 3 years supervised release. The rest of his life is ruined because he has to sign the sex offenders registry. His release date is for 2013 but that will depend on the Supreme Courts decision on whether it is unconstitutional to hold someone beyond their sentence. As of right now there are several inmates being held in federal prison even though they spent their time because they are considered a danger to society simply because they were convicted of a sex crime. It’s ridiculous. The USA has gone way beyond communism…..

    my boyfriend got sentenced last year. he will get out in 2015. his computer was accesible by at least 3 other roomates, not to mention any of their friends. HE got in trouble for it. the fbi didn’t care that other people had access. they made him into some horrible pervert. he had 2 videos that he DELETED in his recycle bin. they call each video about 600 pics. so the newspaper said he had in his possession around 1200 pics. he wanted to fight it. if you fight it, you loose and will get more time. they black mailed him, too, and said that i would be brought up on charges also. (i’m a photographer so they wanted to say i took pics). so he plea bargained. now he looks guilty.
