Prostitute Stings and Arresting Officers
An investigating officer in Sandy Springs had sex with a prostitute just before arresting her. Was this ethical behavior? Officer Jamaal Mayberry claims that it is, and that it’s common practice of investigators to gain the evidence they need for an arrest. His fellow officers disagree. They say in a similar investigation they would not cross that line.
The circumstances were a bit peculiar when a prostitute was arrested in Sandy Springs, Georgia. During the arrest she asked the officer, Jamaal Mayberry, “Can you do that, we just had sex.” And it appeared that he could do that. When the Police Department found out what had gone down. They reprimanded Mayberry and suspended him two days without pay. While they were about it, they found Mayberry had previously had sex with two other prostitutes during a sting.

In return Mayberry is suing the Police Department for discrimination. He stated that he was unfairly targeted for punishment. He says it is common practice for officers to have sex with prostitutes before arresting them.
Officers in the Police Department disagreed with him. They were unanimous that no officer in the same situation should ever cross that line. “It’s not necessary to go that far to make a case,” said Peter Fenton, a criminal professor at Kennesaw State University and former officer of Cobb County. Police Chief Terry Sult further stated that Mayberry’s actions had brought disrepute on the whole Police Force.
During the investigation it was found that Detective Mayberry and other police officers had not had the training they requested before conducting the prostitution investigation. It was brought to light the lack of training for vice operations, lack of audio surveillance and lack of leadership following the resignation of Police Chief Gene Wilson. In spite of everything else it was decided that Mayberry’s lack of judgment was notable. The case were dropped against the woman arrested.
A surprising twist of events occurred when Charles Olson, the general counsel of the Prosecuting Attorneys’ Council of Georgia announced that according to other cases around the country,what Mayberry did was a legitimate investigative technique. But the director of Georgia Peace Officer Standards and Training said his agency teaches that when money changes hands for sex, it’s enough cause for an arrest. There is no reason for the arresting officer to have sex with the prostitute.

What a jerk. He actually committed a crime. Prostitution is against the law for BOTH parties, not just the one selling her “services.”

I think ANY sting operation puts the arresting officer in a position of unlawfulness. Sting operations should be illegal in general.

The action of that policeman is reprehensible. Prostitutes are human too. They should not be abused just because of their despicable jobs. That policeman should be penalized because he is supposed to be a model in protecting the rights of people to include those who violate the law. In this case his action is simply exploiting women because of the position he holds as police officer.

I think the police officer can arrest the women once the money exchange hands for sex and so having sex in this circumstance is despicable.
