Affirmative Action Policy vs. Anti-Affirmative Action

This is a great and intricate policy to explore. It allows one to look at the history of how affirmative action was formed and why. It is also crucial to understand the effects it has in a direct relationship on the criminal justice system. The other side will also be delved into as one looks at the other perspective on how others view affirmative action as preferential treatment. Others feel that this is not equal rights but giving others preferential treatment. There are both sides with their own perspectives to be explored compared and contrasted.

    Another example is say a student applying to college.  This student came from a private institution and had very high scores. Another minority student is also applying.  She has graduated from a public high school in Harlem, NY. City, NY.    She has received normal scores.  The non-minority student does not get accepted to a particular college because there is only so many seats open and the minority student who also has applied is accepted. 

    Another example is the growing feeling and resentment in the different communities as the shift of the population in America tends to be more ethnic.  A example is Miami. Miami has a very high level of Hispanic population.  Suppose one moves there and applies for a job.  The applicant is a white male.  He applies to work for a Hispanic company.  He may also not speak Spanish as well.  Another Hispanic male applies for the same position and does not have the same level of experience. The company decides to hire the Hispanic male. There is their support for their support of bias and not on qualification.

    One can see both perspective and the motivation behind their belief system and their actions relating to this issue. There is a big contrast.  The contrast lies in the issue of discrimination and who is being discriminated.  Both groups see the issue but the major contrast is that Affirmative Action is more than preferential treatment as its about programs.  It is a far reaching policy.

    Now let one examine the issue of the reasoning behind the policies.  The policy is for the protection of values and constitutional rights of all citizens and the right to have the same opportunity for education, jobs, etc..  Implementing policies are not always that easy.  It is to provide the basis for the shared norms of a society.  History has proven that there was social injustice and that not all citizens were treated fairly in the criminal justice system and not allowed the same opportunities.  No groups should be allowed to turn back the clock of time and undo the positive impact of Affirmative Action.  The outcome while not perfect has afforded great people to become great citizens by affording them protection of pursuing their dream with out discrimination.  There are deserving people who had the opportunity and utilized it to further cause and this comes back to the community.  The perspective that Affirmative Action is preferential treatment is not true because there have been great black and Hispanic leaders to emerge in the political arena.  Their voice is a far reaching one as it continues to be heard.  There is many proven minority leaders in this country in many areas, as military, etc.. who has measured up and proven they have what it takes to make a change.  The system of the criminal justice system also has black and other minority judges in place that were not present as much before.  The implementing of this polices has opened the window of opportunity and the door to change in a continuing fashion.  This is a constant evolving process.  Every policy may has its draw backs the over all effect is a great one and policy allows for change and the workable issues to continue to effect lives and the criminal; justice system. It is always positive to move forward and not backwards on a policy that has brought change.  Polices are for the community and is directly related to the impact desired for the community.  People decide that their goals have to have a different strategy and Affirmative Action was policy chosen.  It was a historical time in an era when there was much turmoil and this policy brought answers and solutions to this important issue.
