Chasing The Tenant

Are you a landlord that has a tenant you are constantly chasing for their rent?

Do you have a tenant that is always late with the rent? Are you tired of chasing them for their rent payment? Are you tired of filing out and serving an N4 just to get them to pay their rent?

You can file file with the Landlord and Tenant Board to end the tenacy because the tenant has been persistantly late in paying the rent.

You will need copies of all the N4 notices and the dates they were served along with the dates the tenant finally made their rent payment. You need these records to prove the tenant is persistantly late in paying their rent.

At the eviction hearing the tenant is allowed to bring up maintenance issues as if they had filed an application for maintenance issues. Because of this it is good to have a written maintenance policy in place. Make sure tenants are aware that all maintenance issues need to be in writing so they can be dealt with in a timely fashion.

If you do get a written maintenance complaint you should deal with the problem as soon as possible, whether or not the tenant has paid their rent. Should you not meet your maintenance obligations the late paying tenant may be entitled to an abatement of rent.

The tenant does not have to inform you ahead of time of any maintenace issues they plan to bring up. It is wise to bring all your maintenance records as well as a copy of your maintenance policy to avoid the hearing being adjourned so you can get your records. If you have an idea that the tenant might bring up certain issues at the hearing make sure you bring records to back up your position.

A happy tenant will usually pay their rent on time. However life happens and things come up that prevent a good tenant from paying on time. Good tenants are hard to come by so it’s worth your while to work with them and not always take the hard line.
