Capital punishment or death penalty should have no place in a civilized society. It is a barbaric punishment for a heinous crime done. Being a barbarous act there can be no rational justification for this extreme penalty in a democratic state like ours.
its an absurd idea that a democratic state has decided upon capital punishment. It seems as if the fascist ideology is being practised in the hide skin of democratic ideology). i don’t deny the fact that punishments should be there to maintain law and order. Rather I agree that the intensity of the punishment should be in accordance with the crime done. And it is in this regard that 1 think that life imprisonment can be used instead of capital punishment.
Life imprisonment is also an extreme form of punishment as it cedes away the life of the criminal and he merely survives which is much more difficult. The criminal is confined to the firewalls of the prison and has to do rigorous work as well, fir i> not allowed to meet anyone- be it his family members or friends. And thus, it is a tough and severe punishment to be given. It is tough not only for him hut also for his family members who have to face the impact of Ins wrong doings. They have to bar the social ostracism. Thus a criminal during the tenure of his life imprisonment has to face a death everyday and so it can be said that he dies everyday 2nd exert moment and has to live up with the consequences of his doings.
When a person is awarded capital! punishment then it is like an escape from the punishment for him. He does not face the punishment everyday. He does not fee! the pain of surviving in a prison and his relatives lacing the punishment ol social ostracism just because of his deeds.
The capital] punishment for him is like a rescue from the pangs of sufferings of life imprisonment. He neither feels guilty nor regrets his criminal deeds and so the purpose of punishment, i.e., to make him realise his wrong deeds, becomes a failure.
Capital punishment does not serve the purpose of a punishment and even puts up a blemish mark on the humanitarian character of the democratic state. Capital! punishment violates the fundamental human right i.e., right to life. This does not mean that we should do away with punishments as they will violate one or the other human right. Rather we should prioritize the human rights such that a democratic state is saved from the accusations of violating or not granting human rights and should also serve our purpose. And thus, right to life is much more superior in hierarchy when compared to right to liberty. We can deny a criminal’s right to liberty by punishing him with life imprisonment but we have no right to cede his life even through citing reasons of law and justice. This would be like practising retaliated policy which is also impractical in such cases as we cannot compensate the death of, for instance, ten people by giving death penalty to one person.
