Merchant of Death

New York Southern District Prosecutor’s Office agreed not to use Russian businessman Viktor Bout label “Merchant of Death” in his indictment, says prosecutor Preit Bharar in his memorandum.
Memorandum submitted to the court and Bout protection in response to the first request, sent on April 19. In it lawyer, Albert Dayan insisted on the termination “of the Bout case” and one of the least petition’s principled items has been refusing to use “emotional vocabulary”.
In a prosecution’s memorandum, which requires the court refusal on all the defense petition’s items, said that as a compromise it was ready to exclude this idiom.
The prosecution notes that the term is used not in connection with the same Hollywood blockbuster, where the prototype of the hero was a Russian. “Merchant of Death” – that’s how Andrew Smulyan presented Bout to U.S. special agents, posing themselves as representatives of the Colombian FARC. Brit Smulyan was arrested on the same charge, but immediately admitted his guilt and cooperated with the investigation.
The term “Merchant of Death” will be expelled from the material charges, which will be presented to the jury, said the 60-page prosecutor’s document.
Bout was arrested in Bangkok in March 2008 after the U.S. request and extradited to America in November 2010.
For two and a half years spent in Thai prisons, Bout, who denies the allegations against him, was first acquitted of the Thai court under “terrorism”, and then won two extradition cases in the first instance courts. In all cases, the court found no sufficient evidence against the Russian.
U.S. accuses Bout of conspiring to murder Americans, selling weapons and supporting terrorism.
Court over the Russian was appointed in New York on Oct. 11.
