Troy Davis Has Two Resources to Stop Imminent Execution in The U.s
The U.S. death row Troy Davis, whose case sparked international protests, filed two appeals to prevent his execution within 10 hours on Wednesday, after his strong doubts about the process to submit their guilt in a crime of 1989.
Davis, a black citizen of 42 years accused of killing a white police officer Mark MacPhail in a fight in Savannah, filed a writ of habeas corpus in the Superior Court of Butts County in Georgia (southeast), while the countdown is imposed for execution by lethal injection at a prison in Jackson (77 k south of Atlanta) at 19H00 local (23H00 GMT).
“I hope that we arrest the local court and there are good chances that the appeal be made to the Supreme Court late in the day,” he told AFP one of the lawyers for Davis, Brian Kammer.
“As the evidence has not been available to the petitioner, inclyendo new ballistics tests that contradict previous trial testimony (…) The conviction of Mr. Davis and the death penalty is based on false evidence, materially misleading and inaccurate “says the appeal filed by his lawyers.
“This Court should halt the imminent execution of the petitioner, a hearing on the request and then grant the habeas corpus,” the court document.
In the same court of Georgia, Troy Davis, calls for “stop the imminent execution” just for filing an action for habeas corpus, a legal institution which guarantees the personal liberty of the accused, in order to prevent arbitrary arrests and detentions.
