A Look at Legislation That Protects Artists’ Rights

A look at legislation that protects artists’ rights.

The trend of the 60 years so far is to improve the national legislation and strengthening of intergovernmental cooperation. Perceived to International Patent Classification. It is created an International Center for the patent documents, which are stored in major bibliographic data for each patent document. To create regional patent systems: Munich European Patent Convention (1977) – signs of patent ability established procedures for issuance of a European patent takes effect on the willingness of the applicant in two or more parties agreements on the French-and English-speaking Africa.

Initially, copyright arises with the development of printing. When a printer or bookseller has concluded a contract with an author, even without a law to protect copyright, the contract has a clause that the author can not surrender its rights to another bookseller. Those relations are regulated on the basis of contractual freedom. Printers and booksellers had interest to own exclusive rights to the printed books and this is evidenced by the privileges granted by the monarch. In England, this interest coincides with the interests of the crown. Royal power was considered that the printing of books should be king’s priority and therefore the kings have been assigning patents for printing books.

The first law on copyright is English and it is from 1710 – the so-called Act of Anne. It gives right to booksellers to print books. This law gives 14-year period in which the authors have exclusive rights over their works and after that if they are still alive and have an interest may increase that period by another 14 years.

In English-American theory the copyright system is generally regarded as a property right. Publisher may receive right over the entire copyright in the work. In Europe, it is important the moral element – moral rights are reserved for the author, although the right to use is transferred.
