Advocates Prolong Cases in Indian Supreme Court
You should hope you never get into any disputes in India. Your case may not be resolved in your lifetime if you do.
Well, that is true. There are so many precedents. Advocates tend to keep on delaying the cases, and there is no time limit imposed on them. CBI has recently closed a murder case, and I’d say that was swift. But then, CBI is not on any retainership. As long as Supreme Court advocates continue to receive monies, they will continue to seek deferment.
I do think there should be some way to control this. While I agree that they have to read a lot, and investigate and present their case in the best possible way, I also think that if an advocate is not able to let the case reach its conclusion within 10 years, then he should be made liable to refund the monies with the rate of interest that the banks charge. Moreover, there should be restrictions on how many cases an advocate can handle. As of now, most advocates have a few cases on their hand, and they never appear before the court for several years, each time asking the court for some more time to collect the data. If they cant handle so many cases, they should employ somebody who would be able to sift through the information and bring the data to them. That would generate employment, and give much relief to the plaintiff. As things stand, there are times some cases go on for almost 30 years, and the advocate is in the least concerned that it has been dragged for so long.
I do suspect that there is some sort of consensus between the advocates of plaintiffs and advocates of defendents as well. At times, it is the plaintiff’s advocate who seeks time, while at other times, it is the defendent’s advocate who seeks time. If neither of them are seeking time, it could be death of one of the prime witnesses or something like that.
Wonder if there is any other country that is in so much mess.
