Recent BMW recalls and the lemon laws.

 

BMW or Bayorische Motoren Werke AG based in Berlin, Germany, has issued a world wide recall on its 5-, 6- and 7- models sold between 2002-2010. Its new 2011 models are not affected by the recall. Rolls Royce models built during these years by BMW are also affected by the recall.

 

The recall involves brakes, a safety issue. Fortunately, the recall affects on the power assist part of the braking system. Your car will still be able to be stopped by the mechanical part of your braking system, but you will need to apply more force to stop your car. If you have driven trucks or cars without power brakes, then you will have an idea of the force you will need to apply to stop your car.

 

The closed system involved in the power assist to your brakes in some BMW models has developed a small leak. Over time and at high speed stops, you will need to increase the pressure applied to stop your car. This leak will increase over time, causing you to apply increasing force.

 

Fortunately, BMW has decided to pay for fixing this problem on all its cars, leaking or not, by replacing this part of the braking system. You will be required to bring your car into the dealer for about four hours. This is inconvenient, but necessary for your safety.

 

Does this issue come under the coverage of lemon laws for your car? Yes it does. You will still need to meet the criteria for the lemon law. In most states this includes repairs during the first 18 months of ownership of a car. If your car spends over 30 days at the dealer or comes in for the same repair 4 times, you may have a car that qualifies under the lemon law.

 

If your BMW meets these qualifications, BMW may still refuse to replace your car. This leaves you the option of going to court and bringing suit. You can also bring suit under the car’s warranty and any state consumer laws. Your case should be reviewed by an attorney, but at the cost of a BMW you would certainly want to pursue this. If you win your case, the choice is yours to accept either cash or a replacement car. BMW cannot force you to choose one over the other.

 

Use this recall to review the lemon laws in your area. You may be entitled to a new car or at least a refund. Don’t let this opportunity pass you by.
