Failure of America’s Judicial System

Commentary.

I know, you all think America has the best judicial system in the world, and if you aren’t guilty you can be indicted for a crime much less convicted. Oh man, are you screwed up! What planet have you been living on? Nothing could be further from the truth. Now, I will admit that mistakes are not the norm in the U.S., and that not every inmate in prison is innocent. But, there are allot of innocent people convicted of crimes they didn’t commit because of shoddy investigations, and over zealous prosecutors.

          In America today there is an unholy alliance which is not only allowed to exist, but even encouraged to perpetuate by the judicial system.  That unholy alliance is that of the Public Fire Investigator with the Private and hardly unbiased Investigators who work for the Insurance Industry.  

          I mean, who would you last want to be assisting the fire marshal investigating your accidental home or business fire?  An Insurer not only will assist with the investigation, they happily pay for scene security, Expert witnesses or examiners, forensic testing, virtually ever expensive aspect of the investigation.  The Insurer then even “Interrogates” their own Insured because they can ask you private, priveleged information which the public sector fire marshal is not allowed to ask.  

   In 1998 the Department of Justice initiated a study of fire investigations, and fire science in the United States.  As a result of that study, then Attorney General Janet Reno issued a report, which among other things stated that “fire science in the United States is impregnated with “junk science” and “good ole boy” misinformation, that pollutes attempts to rectify false beliefs.  They forgot to mention that much of this “misinformation” was provided by the Insurance Industry as “red flags” or warning signs of a potential Arson or Incendiary Fire.

   Some of these red flags were 1) crazed glass, 2) pour patterns, 3) “V” patterns, 4) deep charring, 5) Black Smoke indicating accelerants were used, 6) concrete spalling.  Virtually all of these “red flags” have since been disproven by real scientists performing scientific testing.  If you were the last one at the fire scene, if it happened at night, you must have done it!  But, think of it this way. If it is your business or residence, who else would be the last one to leave, and what difference does it make if it happens at night as opposed in daylight?
