Standard of Care

An essay on Standard of Care.

The fact that a higher standard of care is expected from a person with special knowledge or skills is very important to tort law. This is in place to make sure that not only you are getting what you paid for, but also that the job is being done properly by a qualified person.  For example, if you are receiving life saving surgery, you do not want a student in his first day of training performing the operation on you.  The seasoned doctor is expected to know the proper procedures involved and therefore is responsible for providing a higher standard of care.  It is expected that a person with the special knowledge or skills in a certain situation should be using them to their full potential.

            I think that it is fair for certain people to be held at a higher standard of care because they are getting paid o higher amount for it.  A certified mechanic gets paid more than an apprentice because it is expected that he will use his years of experience to provide that higher standard of care.  Other professions or people that I think should be held at a higher standard of care are vets, electricians, plumbers, teachers welders, carpenters and any type of repair man.
