The Constitution and The Issues of Freedom and Equality
The contradiction of the framers who led the fight for freedom against the British Empire, but then allowed slavery in the formation of their independent nation. even after the Civil War with the passage of several amendments to the constitution during reconstruction, racism continued to destroy the lives of African people living in the U.S. Is the Constitution a sufficient document for protecting the rights of U.S. citizens? Should African Americans revere the Constitution?
Any constitution is important and fundamental to any good government, as is the basis of the institutional, allowing to ensure a plain standard of legality, in this sense all citizens should admire, respect and appreciate the great technological value delivered by a constitution, however this revere seems not right if the constitution is conceived as a static artifact, since usually a constitution has clearly room for improvement, through dialogue and reasoned consideration of the government are given crucial improvements to the constitution. Allowing slavery was certainly a contradiction of the framers of the Constitution, obviously they did not respect the freedom of those enslaved men, not certainly applying their rational, philosophical and political arguments that guaranteed their own freedom to those enslaved, since they regarded them as an inferior race, making an exception as if these captured men were not involved in reason, thinking and dialogue, and thus not deserving the fruits of reason and politics enjoyed by the fresh independent men. More than the certain irrationality, inconsistency and irresolution on the part of these officials, ruled the gross and illusory convenience from the enslavement of others, a clear reflection that their knowledge on the legality and freedom was still incomplete, it also reflects the influence of pragmatism which trades with evils in exchange for supposed greater goods, such as “progress” and the accrual of capital. Later the slaves will be free but will yet persist in the perception of people the racism and white supremacist belief. This led to further improvements to the constitution, aimed at eliminating discrimination against African Americans. We admire the constitution as it is a device of the science of law that allows to secure and fully provide with the basis for the freedom of citizens, contributing to an inclusive state where differences are respected, which is able to secure an intelligent deployment of government. Undoubtedly and fundamentally the constitution protects the rights of citizens, as a document is by definition the most efficient, however a gap between the core and legitimacy of the constitutional arguments with the common sense of the population tends to persist, though as these amendments are implemented is also strengthened the general understanding of the population about the meaning of the legal and the institutional, thus strengthening the protection of the rights of citizens.
