Validity of a Will Executed in a Foreign Land

General rule on the validity of a will in a foreign place

1. Will be successful if its implementation is in line with domestic law in force: -

* A), where the will was executed, or

* B), which was the domicile or habitual residence of the deceased, either at the time Will has been executed, or the death of the testator or

* C) that the testator was a citizen, either at the implementation of the will or the testator’s death.

2. The Wills should also be deemed properly implemented: -

* A) a will executed on board a ship or aircraft if Will has been implemented in accordance with domestic law in force in the place where the vessel or aircraft may be considered to have been most closely linked with regard to its registration and other relevant factors, or

* B), provided there is real, if it is implemented in accordance with the law of the place where the property or

* C) a will, provided that it revokes a will or a provision in a will was executed for being properly implemented in accordance with a law, like the previous or the provision will be deemed to have been validly signed , or

* D) will, insofar as it exercises a power of appointment, if the will is made in accordance with the law on the validity of power.

3. A will that apply to the extent that the exercise of a power of appointment, are not considered as having been improperly executed because it was not implemented in accordance with the formalities required by the instrument creating the power.

Nonetheless, we emphasize that it is more appropriate to execute a will that is in full compliance with all local laws. It is preferable to having to establish both the good faith of the will and the country of origin where the will was originally executed.
