Visconde’s Killers Acquitted
December 14, 2010. The Supreme Court has finally reach its decision over the case against the Visconde massacre in June 30, 1991.
Today, December 14, 2010. The Supreme Court has finally decided to rule over the case of the Visconde massacre that have happened in June 30, 1991. This is considered as a huge tragedy that happened to the Visconde’s. The victims having receive multiple stab wounds, rape and was murdered inside there own house at BF home, Paranauque, Phillipines.
The Supreme Court’s decision was not favorable over the victims, reasoning that it did not find any ground that will construe to be believe that will constitute the image as beyond reasonable doubt. Beyond reasonable doubt is the key element that has to be proved in criminal cases in order that to convict the person complained.
Since the decision was done by the Supreme Court, the decision is now final and executory and no longer appealable. The Supreme Court ordered the release of the defendant unless there is another lawful cause to hold them.
Among the defendant that has been acquitted are: Hubert Webb, Antonio Lejano, Micheal Gatchalian, Miguel Rodriguez, Peter Estrada, Pyke Fernandez.
The Supreme Court also based there decision that the defendants has already served there sentence during the trail, as the crime filed is not bailable, the counting of sentence serve would be the day the accused has start to be put in prison or custody.
Comments:
After 10 long years.
The contention of the Supreme Court to acquit the defendant is just and reasonable, although it was hard for the Vizconde’s to accept the fact, there is just no sufficient evidence that the Court can say it is beyond reasonable doubt. Mr. Lauro Vizconde, although was hurt and almost fell down when the Supreme Court release its verdict, says he has forgiven the offenders already.
In deciding a Criminal case, the battle is always fought by way of evidence. It is important that the evidence presented must be consistent and would prove beyond reasonable doubt.
The last question now remains.. If the Court has acquitted the accused then the killer still remains at large. The question would now arise who could he be?

“My SON will not rot in jail – I have a MOLE inside” these are words coming from the mouth of Comdr Fernandez, father of Pyke Fernandez.
All employees from Columbian Motors Bicutan knows about this, where Fernandez is a VP-admin.
