Protecting Our Borders at any Cost

One Border Patrol agent stated that this case is causing BP Agents to second guess themselves, and worries that it will cost more in safety and security as agents won’t be willing to risk it if they think that they might face prison sentences themselves.

There is a war going on at our Southern Border, a war that spills over every day and risks the lives of American citizens living in Border States. It is a bloody war involving guns, drugs and prostitution. How will the war end and who will win is dependent on people like Jesus and Diana Diaz, border Patrol agents, who risk their lives on a daily basis to keep the drug war in Mexico where it belongs. Of course the Mexican government doesn’t want the drug war down there, which is why when Jesus Diaz made an arrest a few years back of a drug smuggler, the Mexican Government cried foul, and the U.S. Attorney General of West Texas picked up the case, and like the good Liberal that he is, Johnny Sutton pursued charges against Mr. Diaz. Mr. Sutton has since left the Attorney General’s office and is now working for a private firm in Texas, what about Mr. Diaz who risked his life to protect us? He is in prison, looking at spending the next 35 years there for this arrest. So what went wrong? Was Mr. Diaz out of line? Was AG Sutton out of line? Should Diaz be freed, and Mr. Sutton investigated for misconduct?

Unfortunately, even if it could be proven that Mr. Sutton was not acting in the best interest of the State, and that he in fact knew about or was somehow involved in the perjury that sent Mr. Diaz to jail there really isn’t anything we can do about it. Mr. Sutton left the AG’s office before Diaz’s trial, leaving it in the capable hands of one of Mr. Suttons’ associates. Still there are many questions about how the investigation and trial were handled that suggest Prosecutorial misconduct did in fact occur. Andy Ramirez, President of the Law Enforcement Officer Advocates Council, stated the he felt very strongly that this particular case was one of the most egregious cases of prosecutorial abuse ever seen. He went on to make the argument that 10 years in prison for lifting the cuffs of a prisoner to get them under control would establish a dangerous precedent the could be used against all law enforcement officers. A scary proposition as it looks to jeopardize not only arrests of otherwise dangerous felons, but it also risks putting police on edge much as the case has place Border Patrol on edge.  One Border Patrol agent stated that this case is causing BP Agents to second guess themselves, and worries that it will cost more in safety and security as agents won’t be willing to risk it if they think that they might face prison sentences themselves.
