Note to Congress: Every New Law Takes Away One More Freedom..

The Republican’s new "Pledge to America" is something I understand. They see a chance for new gains and they are finally hearing the clamor of the Tea Parties – at least somewhat. But they apparently don’t get a basic tenet of lawmaking, and that is that every law restricts someones liberties.

The Republican’s new “Pledge to America” is something I understand. They see a chance for new gains and they are finally hearing the clamor of the Tea Parties – at least somewhat. (Note to Repubs: it’s about principles guys, not press conferences.) But they apparently don’t get a basic tenet of lawmaking, and that is that every law restricts someones liberties.

Don’t get me wrong, I do believe in the repeal of Obamacare. But there is to more to fixing health care in America than simply repealing PPACA. For example we could start with repealing HIIPA. We could do away with restrictive medical malpractice laws. Health insurance companies are exempt from anti trust laws. That could do with some repealing. That allows the health insurance companies to price fix – not only their rates but the prices doctors can charge too. That is so wrong. But what is not going to fix health care is passing more laws. Every time a new law is passed it restricts someones liberties.

If a new appropriations bill is passed it restricts my liberty to have a little more of my own hard earned money. If a health care law is passed it will strip a doctor or a patient or someone in the health care system of a liberty. There are people who should have the liberties stripped. Some examples that come to mind are child molesters, thieves, terrorists and murderers. The constitution was written to restrict only those who should have limited liberties, not average citizens. The free market is set up so that individuals get the opportunity to evaluate a good or service in the market and determine if that good or service is worth spending their money on it. It is not the job of government to nanny the process by restricting the flow of services into the market. But we have become used to having the government approve everything – particularly when it comes to health care.

We didn’t just wake up one morning with Obamacare. We sat back and allowed the collusion of government and groups like the AMA , the NAIC, AARP, the health insurance companies and the drug companies ram their version of health care into our lives for over 80 years. We need more liberties in health care, not more laws.

The purpose for this rant is to warn Republicans that we don’t need new laws we need to repeal bad ones. The Pledge to America promises to repeal and replace the current health care reform law. Please repeal. Don’t replace. One of their solutions is to allow health insurance policies to be sold across state lines. First of all, you can already buy the same Blue Cross policy in California that you can in Utah. Many other states have the same policies. The issue is that the California policy costs as much as 50% more than the Utah policy, because the insurance companies claim that care costs more in California. By selling existing health insurance policies across state lines, form existing insurance companies, it will not lower premiums in California, it will increase premiums in Utah.

The Pledge to America also promises to keep the tenth amendment intact. Right now states control who can offer insurance policies in their state, how much they can charge for those policies, the language in the policies and what must be covered. It seems to me that’s really pretty important. I want my regulation more local. The letter and the intent of the constitution clearly provides for that.

When it comes to the Republicans Pledge to America I am urging lot of repealing and a whole lot less replacing.
