Warning! Warning! Do not do it! You will be let down and may have to sell everything and move back to England before you get residency status. If you want to live in Canada apply for residency and sit it out in the UK. If you are happy to move for one year or so then thats fine but dont believe everything you hear about residencys within nine months. Its a load of crap and theres delays!

We used a lawyer to help us with our move to Canada (Based in Montreal, Can not give name in case we get in trouble for it! However website ends in .ca and has a male that owns and runs it) Basically don’t use a lawyer, Its a waste of money and they don’t do anything extra for you apart from trick you into signing up with them, ripping you off and letting you down.

We were charged 3,500 Uk pounds per family to do an LMO work permit which lasts 1 year. We were told that then to extend when it needed renewing they would do free of charge if we applied for residency with them for a further 1,500. We did and then when it came to renewing they wanted a further 2,500. We tried to argue it out and you couldn’t win. I had it in writing and that meant bugger all. Do not believe everything you are told and to be honest you can do all the paperwork yourself. the residency is simple enough and they even give you advise if you ring the Canada office.

We applied for residency in the so called “fast track” option which should take 9-12 months. We had been in Canada for 12 months and hit the problem where we had to apply for our own work permits which we got extended for a further 2 years but it was scary and got declined twice. We have now been here almost 2.75 years and still not been requested for a medical. We are still with the lawyers office and they are not willing to help us with anything now apart from if we pay for a new work permit with them but Canada Services HRSDC make it so difficult to renew and they are making it harder and harder. It is a great worry.

If you are still in England and considering the LMO process I urge you to stay put and apply from home. We had to sell everything and lost a lot of money to move to Canada. We have lived in horrible situations whilst been here and finally bought a home to find that we may have to leave in a few months to go back to England until we get an answer on our residency so then as you can see we would have to sell everything again or arrange something and when back in England where do we live and what life do we have. Been like a Gypsy for about 4 years now has been a big shock and waste of our life. Its is a shame and due to the stress and worry of the applications we have not really been able to enjoy our time in Canada. We would have been better staying with our families in the UK and spending additional time with them before leaving.

Further delays hitting residency applications so what are your options? They do state that files are processed in file order but I know from our experience that they are not.

We travelled to Canada as 3 family applications and although we all applied at the same time one of the files is still in processing. It has been an additional 24 months since the other 2 files were requested medicals. At first we thought maybe there was a problem. Ie a missing document or something but upon chasing it we found that they had hit delays. It did seem strange that we had been waiting a lot longer when they all went in within a month of each other. We have chased the application further and been advised that they received double applications to what they expected which was resulting in the delays. So far everyone we have spoke to has not been able to comment on why we are waiting so long when they all went in at the same time. It states they are done in order but I doubt that very much since the processing times have just been delayed yet another 4 months and we still have not heard anything. 24 months later so far just to wait for a medical. I have checked and even asked our Canadian MP to check in to see if there’s a problem and have been advised there’s nothing wrong it is just simply waiting to be processed. I don’t understand why there is such a huge delay and surely they have not done anything for 2 years which if their information stating they are done in order is correct would show that. How can 2 years later they not have reached a file.

So many things run through your mind. Is there a problem, Are they going to decline it? What can be the reason but no one can tell us anything and we are still within the new processing times so we just keep getting fobbed of with the same excuse. Since we have been working in Canada now for over 2 years we can now apply for residency through the experience class so either way we should qualify. There’s no points on the experience class. Just experience, that’s it! (Well pretty much) We have a job and have been employed for 3 years, We have now submitted an extra application for the experience class just to cover ourselves in case further delays are added. Experience class processing times are currently showing 15 months compared to the present 27 months for the skilled worker applications. Both files could still hit delays but what else can you do when further delays are added. I would have hoped that Canada would look after their foreign workers. They advertise that they want skilled workers and then don’t help them to settle and stay. It is wrong and I hope to see changes where they do more to help people moving their entire families to make a new start and work for THEIR country!

If you have been a skilled worker in Canada for 24 months or more you can apply for residency using this application. The original skilled worker application is hitting delays and this is now a shorter processing time.

We have currently been living in Canada now for almost 3 years as skilled workers and applied for residency in the September upon arriving. So far the residency application has been in for apx 2.5 years and we still not have been requested for a medical. Our application was under a skilled worker category and at the time we applied it stated processing times of apx 13 months for the UK London office. However, after the processing times changed last year to 23 months we still have not heard from the office and in the last few weeks it has changed its processing times to apx 27 months. Since arriving a simple application process has resulted in re applying for work permits which we are currently in the 3rd year and need to apply for a new extension. It is unfair to foreign workers that they have to do all the extra applications when residency has been applied for and still be in limbo due to extending processing times. A work permit is not necessary going to be extended especially if the employer was slow for work over the recession for a few weeks as Canada services class this as the employer not having sufficient work for the employee and don’t necessary need them which is wrong. A lot of skilled workers trades involve working out doors and sometimes the weather can effect their working week. We have been advised that files are processed in order of receipt and I can guarantee to you that they are NOT. We came as 3 family’s and 2 of the applications were processed in October 2010. That is over 1.5 years ago and this one file has not been dealt with yet. So why not? I have been assured there are no problems with it and they don’t need anything it is just waiting to be processed and they have back logs. How can they be 1.5 years behind at least so far when the applications were submitted at almost the same time and they are doing them in order. Your not telling me that within a month they received about 2 years worth of applications. We have contacted the minister of immigration who did not really respond to the matter and our local MP who actually contacted the office as was told the same as us. No one can comment on the delay.

After being a worker in Canada for 24 months however you can apply for experience class which the processing times are currently showing as 15 months so we are putting an additional application in to run along side the other one (Which is costing $1100 just to submit it) just in case the original application hits further delays. There’s nothing we can do and if the work permits are not extended then leaving the country is the only option other than to request visitors status which costs extra money and does not allow you to work or have any health coverage. The system is just rubbish. Once you are hear and working they should make it easier for you to stay especially if you have a residency application in that has come across significant delays. I can not see this being rectified before we run out of time and our whole family are going to suffer. The grandchildren will not see their grandparents and vice versa and they are the only grandchildren. Our family is going to be split and torn apart until something happens.

When it comes to social change and the creation of a social distortion the debate over immigration can be costly as the Garcia family found out.

During the 2008 presidential elections one of the most highly contested topics of debate was that of illegal immigration and immigration reform. It seems that every candidate and every individual cross-country had his two cents to put into the opinion pot. The arguments varied from costs on the economy, criminal activity, and just plain old prejudice. The solution, overwhelmingly, was to send every illegal alien back to his country of origin. The country saw protest after protest, the rise of the Minuteman, and the defeat of more liberal politicians.

When it comes to social change and the creation of a social distortion, what other area of debate could possibly provide so much contention. Sometimes an individual, a politician, our nation and its government must recognize that some things are just right or wrong. Sometimes, there are no words to create a perfect law to solve every situation. Sometimes, the situation shows up front what needs to be done.

On July 23, 2011 a young teen male, living with his grandmother in the Honduras, disappeared, to be found three days later murdered at the age of 20 years old. Josue Rafael Grellana Garcia was an individual who illegally traveled to be with his mother in Jersey City New Jersey. In 2008 he applied for asylum in the United States afraid that he would be killed by gangs. The US courts denied him asylum deporting him in 2010.

According to his mother the young man was picked on from an early age because of his disabilities. During hurricane Mitch, which struck the Honduras in 1998, he was injured by a falling tree costing him an eye and much of his hearing. With age, the threats from bullies and others increased in intensity. His mother who was working in the United States legally advised him to flee the country.

Today the family is seeking posthumous asylum for Garcia in an effort to make the United States government recognize that they failed this young man. Perhaps these efforts will make US immigration expand or add .new standards for seeking asylum, standards that might have allowed Garcia to live. Social distortions of this magnitude are among the worst but are all too often prevalent in our society. Perhaps the 2012 presidential candidates should take a moment to remember Garcia.

My school debate for stricter immigration laws this is my side that is against it.

Over 38 million legal immigrants live in America, while about 12 million have snuck their way in. Why should someone have to sneak to get into the land of the free? The only person they should have to sneak from is the dictator of their corrupt government. We should be welcoming these immigrants with open arms. America was founded and built up by immigrants; in fact in between that lucky day in 1610 at Plymouth Rock and 1776 when the United States was founded every single American citizen was an immigrant whether a first generation or a “anchor baby” (excluding the American Indians). The future goes on and more and more immigrants pour in. The peak year of European immigration was in 1907, when 1,285,349 persons entered the country. By 1910, 13.5 million immigrants were living in the United States. That is when America decided to restrict the amount of immigrants allowed to be admitted into the land of the free, and also when illegal immigration first started. Even during World War II America still restricted the amount of certain races that could enter the U.S. Thinking about this poor decision I am wondering; How many people died during World War II because we were negligent and didn’t allow these refugees fleeing their country because of their imminent death into our homeland?
Many fall into believing that illegal immigrants cause this country to be falling apart. Some even are naive enough to believe that legal immigrants cause this country harm. When in reality immigrants are much harder workers because of these prejudice. Us labeling immigrants as legal or illegal is just creating our problem. If we didn’t classify anyone as an illegal immigrant then we wouldn’t be spending money imprisoning them, they wouldn’t be able to slip under the radar and not pay taxes, and they wouldn’t be stealing jobs from other “Americans” because although they are immigrants they are still citizens of the land of the free. They are willing to work twice as hard for half the money because they have something to work for. “Those that having nothing to lose have everything to fight for.” They are literally fighting to stay alive to come to America.
I have heard tons of people talk about immigrants being lazy and thieves. But in reality they are the hardest working people you will ever meet. You may say that immigrants cost the government so much money. But why should someone born into America get welfare but an immigrant shouldn’t because of their bloodline? Isn’t that why we became a democracy and came out from under Britain’s crown?

Republican candidates are advocating for English as the "Official Language" in the United States. If this were allowed, America would no longer be "The Land of the Free and the Home of the Brave."

America has long been considered a “melting pot.” People of many languages and cultures have been welcomed to our country to make vital, important contributions. Immigrants to America have historically been great inventors, businessmen, politicians, and educators, artists, and religious figures. There is Albert Einstein, Irving Berlin, and Joseph Pulitzer to name a few. These Americans have contributed a legacy to our country that will forever remain.

Recently, some of the Republican candidates for president including Mitt Romney and Newt Gingrich have called for English to become our “official language.” This is just another political maneuver to convince the public that Republicans are truly American and deny rights to people who have immigrated to our country.

Even though Romney and Gingrich both advocate English as the “official language” they are in Florida doing commercial campaigning in Spanish language to attract voters. Talk about hippocracy.

I was raised by Eastern Europeans who never spoke English well. Yet, they were able to run a small business and raise a fine family in America. At present, I tutor English language skills to Hispanic Americans and Asian Americans. I can tell you that people who speak languages other than English work very hard to assimilate in the United States. They are anxious to succeed and have their children be educated and successful as well. In addition, immigrants are anxious to improve their ability to communicate and be better citizens.

We cannot have a benchmark for language skills. If we did, our American society would lack the culture and contributions that have always made it great.

If you knew that you were married to a bigamist what would you do? Bigamy laws in UK and considering the issue...

HOW PREVALENT IS BIGAMY IN THE UK?

I’ve known two people over my lifetime who were innocent victims of this. In their cases, it seemed to many to be a relatively “harmless” crime since in their cases the men were no longer living with or having conjugal rights with their legal spouses. However, it isn’t a victimless crime really as the women were traumatised by this and moreso their children suffered as a result of them ending the bigamous relationships. Their feeling of betrayal, their anger at having been deceived, and the fact that they could no longer trust men who had lied to them had an impact on them and on some of their extended family. It was hurtful to say the least. The aftermath had them thinking of what would have happened if they had lived out their married lives not knowing, only to find out at the end of their husband’s lives they would not be entitled to any Widows Benefits, Funeral Grants, the contents of their Joint Bank Accounts, a Pension based on their husband’s National Insurance Payments, and even the contents of their own home or the house itself, but the legal wife would. Scary, isn’t it? So much to lose if they get off with it.

THE LAWS ON BIGAMY IN THE UK:

Bigamy comes under the PUBLIC NUISANCE category in Law. This is covered by Section 57 Offences Against the Persons Act 1861. The maximum penalty for proven bigamy in a UK court is 7 years imprisonment, a fine or both. The court takes into consideration mitigating factors such as level of injury caused and deliberate avoidance of immigration. The second factor is one worthy of consideration.

THE PEOPLE I KNEW WHO WERE IN BIGAMOUS MARRIAGES WERE MARRIED TO PEOPLE WHO WERE FROM THEIR OWN COUNTRY

That is something that the system now needs to look at. I have to wonder if I turned up at a Register office with my birth certificate, would they do any checks of any kind on whether I was married or not? Do they rely on certificates presented or do they do checks?

DELIBERATE AVOIDANCE OF IMMIGRATION:

There are people who come into UK from countries where Polygamy is legal and because they are allowed more than one wife in their own country and they are unfamiliar with the laws about bigamy in UK they think it is okay to take on a wife in UK. When they do, they deliberately keep them in the dark about the other wife or wives as they know UK women expect to be one wife of one husband. PROBLEM their wives wonder why they can’t go visit their husbands families, why they don’t call, why none of their family in UK came to their wedding, sent a card or gift. Alarm bells ring! They don’t have residency and want it. Who can be so heartless that they don’t understand that people in less privileged countries would want to emigrate, to get out of that poverty rut, to find a better life in another country? God only knows, I was a “Ten Pound Pom” and emigrated to Australia on an Assisted Passage in the 1970s and can really understand why people would want out and to be in a better place. I have a hard time getting my head round why anyone would want to put themselves through the stress of leading a double life, the constant double dealing, the constant lying and deceiving knowing that they could be caught out at any time.

FACT: IF REGISTER OFFICES IN UK HAVE ANY REASONABLE DOUBT – THEY FEED THAT BACK TO IMMIGRATION CONTROL.

No need for concern if people can supply legal right to be in UK at the time and they can produce the paperwork that they ask for.

FACT: YOU HAVE TO LIVE IN UK FOR 5 YEARS TO BE ABLE TO APPLY FOR PERMANENT RESIDENCY.

The bigamy issue has to raise its head within that 5 years and people hoping for permanent residency have to be aware of that. Doing anything fraudulent is stupid, dangerous, and it is better that people wanting into the country stick within the laws of the country.

QUESTIONS: UK people and people in other countries with big immigrant intakes and applicants…

PEOPLE CONSIDERING MARRYING PEOPLE FROM OTHER COUNTRIES:

Where did you meet them? Internet? Alarm bell ringing? Anyone can set up a fraudulent account or email and can conceive you. (Know guys who have been there!)

How much do you know them?

Have you been there and met all their family?

IF YOU HAVE DOUBTS – DON’T EVEN GO THERE!

You risk jail and deportation.

IF YOU ARE FROM OVERSEAS – DON’T GET INTO A BIGAMOUS RELATIONSHIP.

If you are truly single and get into a real relationship with someone in UK You have absolutely no problems, but a long haul issue to deal with. It is not worth it. YOU WILL BE DEPORTED!

The ladies or men you get involved with will eventuallyfind you out and report you if you do that.

KEEP LEGAL!

Travel, Immigration, visa bulletin.

The National visa Center publishes the visa bulletin every month, for the purpose of providing information about immigration. This is particularly important to people who have applied to immigrate to the United States on employment basis, or can be useful to spouses of legal residents in the United States but residing in other countries.

It is important to note that the Visa bulletin summarizes the availability of immigrant visa numbers. These numbers are given to petitioners upon successful filing of a case with the Homeland Security, and are also called the priority dates.

Every month, the state department allocates visas to those who have priority dates on a first come first served basis. If not all demand is satisfied, the category for the particular visa is deemed to be oversubscribed. If this happens, numbers available are moved to the following month and where there is excess demand, retrogression may occur.

A cut-off date for an oversubscribed category is the priority date of the first applicant who could not be reached within the numerical limits. Only applicants who have a priority date earlier than the cut-off date may be allotted a number. If it becomes necessary during the monthly allocation process to retrogress a cut-off date, supplemental requests for numbers will be honored only if the priority date falls within the new cut-off date announced in this bulletin.
