Mr. Jura had decided to join and lead a labor union. He had no idea that a catastrophic event was about to change his life. The new management of the company he worked with had taken over the former management - started reorganization and changed some of the company’s policies. Mr. Jura had worked for seven years as an accounts officer with the company.

Image via Wikipedia

The new management hired new personnel and employees. But on a certain account, they used cost – cutting procedure. They used to cut on the number of employees on a certain department. The company had introduced forced labor effectively. It affected to the old employees especially. They obliged their employees to do the jobs and responsibilities as the same as supervisors.

He explained, “I handled so many loan accounts, including monitoring, collections’ procedures, and other legal documentation. I could see that there were discrepancies. Promotions and salary increases were awarded and mostly enjoyed by the newly hired personnel. I have a pending promotion that the company had promised. The harmonious relationship between the employees and the employer had become chaotic. Favoritism had become obvious and the situation became worst.”

Those strategies that the company practiced had increased Mr. Jura’s desire to organize a labor union, of about two hundred members, with the primary objective of protecting the employees against the unfair labor practices of the company.

During his active Leadership – Mr. Jura noted that some of the union members were afraid to negotiate with the employer. He said, “There was a strong warning by the company, to terminate employees involved to such activity.” But despite the management cautionary action, the union stood its ground vigorously and there were more struggles.

“I concluded two Collective Bargaining Agreements (CBA) with the employer. The first CBA had taken us by eight months to negotiate with the employer. In the middle of negotiation with the company, they offered me promotion and money. But I had never accepted it until it ended up with deadlocked bargaining. Those eight months of bargaining with the employer had brought us too much difficulty. I really needed the money to sustain my mother’s hospitalization and to support my family. It was really hard for me to handle the situation. But this had not affected my strong desire to lead the union. But it was difficult to render a visible protest against the company’s unfair labor practices,” he said.

The plans on a Yes – to – Strike. The union members wore arm – bands with slogans, and had picketed in front of the administration’s building. It took them a month. But the company still did not alter its decision. They felt that their crusade had failed. Their struggles seemed to have no success. These were months of desolation. It affected Mr. Jura greatly. That period of his crusade with the union had made him crippled. His mother’s condition had affected him. The agony had penetrated his heart, brought by the disturbing events, but he had never deviated from his decision. Courageously, they have said, ‘Yes to strike,’ through a consultation with the Department of Labor Employment (DOLE).

The plans on a Yes – to – Strike by the union had worried the company. So the company bribed one of the employees of DOLE to release an assumption order to stop the possible strike of the union. But the union went through with their crusade that urged the company to grant some of their demands.

In that provision, all employees, either union members or non – union members will receive 3% profit shares from the company’s annual income.

According to Mr. Jura, the first and second distributions were in good faith, while the third time of distribution was shocking. They found that the non – members received a greater amount than the union members. This urged Mr. Jura to request a consultation with the management, but to no avail. The management justified it as their prerogative. This made the union open their second CBA.

Their second CBA with the company was not as fruitful. Their legal counsel (union) had renewed some of the existing provisions stated in the CBA. The management (company) bribed their counsel with some money.

“We continued our struggles. We filed the case with the National Labor Counsel. The issue was for equal profit sharing. Luckily, we won the case, after two long years of labor hearings!” he said.

Mr. Jura felt jubilation to win the case. He never sold his principle and dignity to the company. He would cherish it throughout his life span and share it to his kids. He resigned from his job with dignity and pride. He said, “Courage and Unity were the best weapons to Victory.”

“It was really difficult to handle the situation. I lost my job. I have a family that needed my support. Those disturbing events that happened to me did not diminish my strength and willingness to live and survive, but I strive more to keep on living,” said Mr. Jura.

He added, “If it happened to you and you lost your job come down and never get mad. It is not the end of the world for you. There are more opportunities for you to find a job. Jobs are there just around you. Think positively. Don’t just put yourself in a corner, remembering those bad experiences that happened to you before. Maintain a good relationship with your family. Trust and understanding are really needed in this situation.

“Your family is your outlet to discuss what is good. See your friends. They are willing to help you. They can refer you to another company that needs your services. Deliver yourself to the Good Lord. He is always behind you to support you, to guide you. He is the first and the last to seek for help because hope is there.”

At present Mr. Jura is working as a Secretary at a Construction Company in the Kingdom of Saudi Arabia.

It is said that Demonstrations and Rallies are adding to the fear of investors depriving ourselves of the investments needed to kick-start the economy but they also help to check our officials wrong doings!

Revocation of the agency

By

shahzadi queen

An agency may be revocable by the act /declaration of the principal or by renunciation of the same by the agent.

(i) By the express revocation thereof by the principal; or by renunciation of the agency on the part of the agent himself. Such revocation or renunciation is effective notwithstanding that the agency was created by deed or for valuable consideration, and may be verbal even though the appointment may be by deed. But though it determines the authority it does so without prejudice to any right that either party may have against the other to damages for breach of contract.

(ii) By principal’s death, or by his becoming bankrupt or mentally disordered so as to be incapable of consenting to the agency, whether or not these facts are known to the agent, by the death of the agent or his becoming similarly mentally disordered or by his bankruptcy, if this makes him unable to perform his duties.

(iii) By efflux of time, where a specific period is fixed either by express agreement or by the usage of trade, for the execution of the act to be done by the agent.

(iv) By the execution of his commission, whereby the agent becomes functus officio; by the destruction of the subject‑matter of the agency; or by the happening of an event which renders the continuance of the agency impossible or unlawful. Thus, the retainer of a solicitor normally ceases when his client becomes an alien enemy; though not merely because he becomes an enemy alien. (Chitty in his book Law of Contracts)

Authority of agent explains

By

Shahzadi queen

Persons employed by another person to transact business on his behalf with third person would be deemed to be agent. Person employing such agent would be known as principal while donee of authority would be agent. Agent was, thus, intermediary, who was authorised by principal to deal with third person and acts done by him were binding upon principal. Agency would create jural relationship between principal and third person. Nature of such authority was personal, non‑transferable and essentially revocable. Such authority, however, would be subject to certain terms created by contract and recognized by law. Where agent had interest in subject matter of contract such agency would be permanent and not revocable. Interest in subject matter, must, however, be anterior to agency and it must not arise subsequently or incidentally. Where agency was created with adequate consideration and was designed to serve as security for some interest of agent, such agency was irrevocable.

My opinion on the benefits of respect.

My parents always told me that the most important thing in life is to respect others and to be respected. When I was a little child, I found this thing very weird, but as time passed, I realized that they were very true.

After getting a bit older, I started to live my life based on this principle: Respect others, because I will be respected in return. And without respect and self-respect, life has no value.

When I meet a person, I give my respect in advance and expect to be respected by the other person in return. If this happens, I usually develop a nice friendship with the other person. And we know that this is what we need in order to be happy in life: human connections and relationships.

Respect is the base of every human relationship, other emotions, feelings and actions are built on the existence or non-existence of respect. Because of my nature of being a respectful person, I have made myself many relationships with others, no matter where I was. And I feel very well, knowing that I am a respected and liked person wherever I go.

A religion teacher once told me that without love, a happy life on Earth is impossible. Then he added: without respect, love is impossible. So the conclusion is: without respect we have nothing, we are unhappy beings.

I advise others to try to guide themselves after what I have just shared. I am not telling anybody how to live his own life, but I think that in a world where people respect each other, we don’t have to be scared and we can live in peace.

In June 2010, a strange man walked into a school.

In 2010. June, a strange man with a hoodie walked into a school in Estonia. He carried a suitcase with him, where he hid a bomb. He walked into an empty corridor, when students were having their lessons. He took out his cellphone and called to the principle. The principle set the alarm and everyone had to evacuate the school. The bomber had a gun with him.

When students got out of their classes, they had to evacuate silently, but the bomber was just around one corner of a staircase. He put the bomb in the staircase and waited. When almost every student had left school, a guy looked at the suitcase and you know what? He opened it!

What happened then?

Nothing. The whole thing was an experiment. My father, who is a police officer, was behind everything. If it would have been real, the bomb would have exploded and it would be a catastrophe. The guy who opened it was about 16 years old and near him was a biography teacher. My father planned it for a month or more and he was the only one to know about it until the Rescue Agency came.

The experiment did not go well at all. Why?

1) The students were too close to the school when the threat was made.

2) Some students locked their classroom, even though they had to get out of the school.

3) The worst thing was, that the bomber saw everyone from the window. He could have shot them any time.

4) The students ran out of their classrooms carelessly, even though the bomber was just around the corner. With a gun and a bomb.

5) Some teachers still stayed in the school, carelessly walking around the school. A French teacher was just around the corner. The police officers could have shot her. Some people didn’t even care what was happening and went to eat in the diner.

6) The bomb evacuating machine was too slow. Even though it could have cost over 1.5 millions, it didn’t even manage to get down the stairs very well. And it was too big.

The whole thing was caught on a tape but it’s not access able, only if you belong in a police team or something.

Reflection about Declaration of Human Right's legacy.

The conceptualization of human rights is linked to its origin and foundation, an issue that is widely debated within the moral, legal and political philosophy.

The concept of human rights around the values of dignity, freedom and human equality, is the affirmation of the value of the human person and its protection as the foundation of a whole legal and political order. The definition of human rights gives them universality and absolute character.

The Declaration of Human Rights has broad contours, so that their assumptions are accepted and assumed by different ideologies. Represent a minimum core of consciousness that humanity has of its own values and fundamental principles.

The historical value of the Declaration and its current term are that it is the first document in the history of universal scope, in which the rights and freedom of the whole human family are included.

This document emphasizes the foundations of the indivisibility and interdependence of all human rights (civil, political, economic and cultural) to recognize them the same need for protection; the community must internationalize them in a global and coherent manner.

Currently there are numerous ethical conflicts that arise within the aspiration of protection of a person; it is necessary to widespread acceptance of certain standards of conduct and a concerted effort of civil society.

Tip for being more productive

As someone who has worked in retail for a number of years and someone that likes getting things done quickly and efficiently, I have come up with a tip that may speed up common processes found in retail environments as well as any other environment that may have repetitive task.

The idea is based off the assembly line process. For anyone that doesn’t know, assembly lines work efficiently by breaking down a process into a whole bunch of little steps focused on one little aspect of the entire process. For example, in automobile manufacturing, it would take forever for one group of people to build up every little piece of a car from start to finish. Instead, the car is set on a track that passes by different stations each with a small set of responsibilities. One section might be responsible for putting the screws in to hold the dashboard, while another section is responsible for mounting the doors. All day, the sections just do the same task over and over.

This works efficiently because you do not have to constantly switch tools, or movements to change between different task. You develop a rhythm and can usually assemble our part of the car much faster than if you were doing every part of the car.

So the idea is the same when you are at work. The example I will give is based in a retail environment, stocking shelves. For this example I will make it simple and say that I am stocking a display, so all the items on the pallet are the same and I know for sure they will go up.

So when I come to situations like this, what I do is I pull off a group of boxes and lay them in front of me with the tape I have to cut all facing the same way. Then I take my knife and go through and cut every box in the group, without having to change the motion of my hand or having to pull my knife out each time. If a box is also taped on the side edges, I will then switch my movements to that direction and get all of those edges next.

Once the tape is cut, I open all the flaps and then flip the boxes one at a time to slide the product out. Then I put it all on the shelf. I have found that this method of stocking has sped up the process for me 2-3 times faster than someone else stocking one box at a time. I broke down the steps of opening a box into repeatable smaller steps and focused on completing one step at a time for a larger number of boxes.

This may seem obvious or maybe silly to you, but if you are interested in speeding up your work, I’d definitely think about the task that you find yourself doing quite often and see how many actions you much switch between to do something. If it is more than one or two, you can probably accomplish those repetitive tasks faster by breaking it down into steps. Perform step one on all of your items before moving to step two. Whether it is going through and approving documents in an office, or making a large order of burgers at McDonalds’, most things, with some exceptions, can be tackled more efficiently by using this simple assembly line principle.
