			<content:encoded><![CDATA[<p>Who would have thought that the bathroom would come up in public discussion? Talking about bathrooms used to be taboo, but not so anymore. As of late, the bathroom fiasco in schools has appeared on the public&rsquo;s radar. Parents and students alike are up in arms about bathroom policies in school. Some of them are fighting the wrong battle, while others have the right to be fired up.</p>
<p>Let&rsquo;s be honest, everyone needs to use the bathroom. Not everyone has to use the bathroom as frequently though. Bathroom rules vary widely. Sometimes the school sets specific bathroom break times and limits how many times students may go. More times than not, it&rsquo;s up to the teacher to decide. There was an article about a New York teacher who chose to limit students&rsquo; bathroom breaks to three per week. She also had the common sense rules of one student at a time, you have three minutes, and you must ask plus sign in and out.</p>
<p>I personally don&rsquo;t agree with the New York teacher&rsquo;s limit of 3 bathroom vouchers per week. If students don&#8217;t use up all of their vouchers at the end of the week, they can turn them in for prizes. Going to the bathroom is a natural occurring event, why should prizes be associated with it? That is unrealistic for many students, especially elementary students. In elementary school, students usually remain with one teacher for the  day with the exception of art, music, library, and gym. Those students  don&rsquo;t have an allotted time to go to the restroom if necessary. This New York teacher came up with such a strict policy due to the many disruptions in her classroom. I completely understand that sometimes students abuse their bathroom privileges, but why punish the entire class?</p>
<p>When I notice one of my students is asking to use the restroom frequently, I monitor the times that they are asking, check on them in the hallway, and ask them what is going on. If I notice that they&rsquo;re playing in the hall then I limit their bathroom times. When several students need to go, it&rsquo;s simple, the whole class takes a bathroom break. No, it doesn&rsquo;t take as long as you&rsquo;d think. It is very organized, we line up and if you need to go you stand on the side with the bathrooms. If you don&#8217;t need to go then you stand on the opposite side facing the classroom. Yes, if I allow my students to go, they must take the pass, sign in/out, and I time them. Other teachers set up three class bathroom breaks and if a student needs to go at another time, it has to be when the teacher is not teaching. This basically means when the students are doing work.</p>
<p>Parents should be mad. I&#8217;m mad and I&#8217;m not even a parent, but I&#8217;m a  teacher. I get to use the restroom when I first arrive to school, lunch,  and planning time. If I need to go any other time, I&#8217;m pretty much out  of luck and have to suck it up. If your child&#8217;s teacher attempts to  implement strict bathroom policies like the above, ask for a meeting.  When you meet with the teacher, administrators or whoever you&#8217;re meeting with, have a list of suggestions.</p>

<p>Before officemates even consider being drawn into an office romance, they should ascertain whether company policy allows it. If not, then two officemates becoming involved with each other will be tantamount to playing with fire, in more ways than one.</p>
<p><strong>Maintain Professionalism</strong></p>
<p>If ever officemates do get involved with each other, they must always remember to separate the personal from the professional. Both parties must never allow the relationship to affect the quality of their work. They should avoid romantic behavior in the office, as well. There must be no displays of affection in their place of work. Such behavior should be kept outside of office hours, and preferably where it cannot be witnessed by coworkers or, especially, bosses. Likewise, if those involved are having a lovers&rsquo; quarrel, there should be no hint of this in the office, particularly in how they work with each other. Manifestations of personal differences can only have an adverse effect not only on how they perform on the job, but on whether they will continue to keep their jobs.</p>

<p>The office romance that is really potentially hazardous to the office environment, and to the continuing professional health of the employees involved, is the kind between personnel of different ranks. Such a relationship can hurt the chances of getting a raise or a promotion for those involved, at the very least. And, unavoidably, such a relationship will always carry an air of inappropriateness to it. One executive reports that when she brought her boss and an employee with whom he was in a relationship to a meeting, you could feel everyone&rsquo;s eyes on them, and the tension was so thick you could practically hold&nbsp;it.</p>
<p>Often, feelings are difficult to hide, and if officemates have romantic feelings for each other, these are bound to surface sooner or later. Some office-sharing sweethearts may choose to carry on a romance in defiance of company policy that forbids it. In this case, those involved must at least be very discrete about their relationship. In the end, this is the question employees in such a situation must ask themselves: Is it worth risking the loss of their jobs?</p></p>

			<content:encoded><![CDATA[<p>If you wanted a review about how godawful the latest <i>Final Destination</i> movie is, you wouldn&#8217;t have a hard time finding one. I&#8217;m not here to give you that though; in fact, I want to do just the opposite. For a series that has so far provided fewer entertaining sequels than <i>Good Will Hunting</i>, <i>Final Destination 5</i> actually manages to deliver something that passes for entertainment. I&#8217;ll even go so far as to say that it&#8217;s the best installment yet, and yes, I&#8217;ve seen them all (come on, so have you&#8230;).</p>
<p><i>Final Destination 5</i> releases on DVD today alongside such future classics as <i>Apollo 18</i> and <i>A Good Old Fashioned Orgy</i>, and if you have nothing better to do on a Friday night do yourself a favor and check it out. It&#8217;s dark and grisly, there&#8217;s some humor, and you might even like it if you&#8217;re drunk enough. Sorry, no boobies in this one.</p>

			<content:encoded><![CDATA[<p>The  good landlord has to follow a few important rules that will help him  prepare the property inventory, rent the property securely and prevent  any challenges the tenants may pose to his property.<br /> To avoid any potential lawsuit, the lessor should make the estate  compliable to a few health and safety regulations. To avoid any fire and  health risks, the landlord has to provide fire safety environment. If  there are any doubts considering the fire resistance of the interior  installments, gas and electric equipment, they should be replaced or  repaired immediately. It is very important to  service the gas installation in order to prevent any explosions or gas  leaks. The landlord should present a safety certificate to the tenant  that proves the reliability of the installation. Last, but not least,  the lessor has to be sure that the electric installation and electric  tools given to the tenant are operating properly and all of the safety  data should be kept during the tenancy.<br /> The landlord and tenant have to sign a Tenancy agreement, which points  out all of the important details about the two parties, the estates&rsquo;  characteristics, the rent, and both parties&rsquo; obligations during the  tenancy. This is the most important document the lessor needs to have,  as it serves a crucial role in the settling of any potential disputes.  The most widely spread variation of this paper is the AST (assured  shorthold tenancy agreement) which requires the lessee to be a person  (not a firm), the rented estate to be his prime home, and the property  to be rented as an individual housing.<br /> Before renting, the landlord has to make a full inventory report of the  property. He can do this by himself or use the help of a specialized  company. For example if the lessor rents an estate in <a href="http://www.inventorieslondon.co.uk/" target="_blank">London inventory company</a> services may aid him greatly in the making of the <a href="http://www.inventorieslondon.co.uk/" target="_blank">property inventory services</a> protocol.<br /> It is normal to get a safety deposit from the tenant, in order to  motivate them to keep the estate undamaged, or else the landlord keeps  the deposit for repairs. A certified third party should keep the deposit  and act as a moderator if any disagreements occur.<br /> It is the landlords&rsquo; responsibility not to discriminate people by not  renting them the estate as a result of a disability, as it&rsquo;s a criminal  offense. The lessors duty is to accommodate the tenants safely, provide  them with all the important data they need and to be available for any  information or assistance needed by them.</p>

			<content:encoded><![CDATA[<p>I looked up wiping the sweat of my eyebrows. The summit was no where in sight. I looked down at my feet which by this time were shaking and paining. There were bruises on the side of my legs. My knees as well as my back were hurting. I looked up at my fellow hikers and almost felt a sense of relief when I saw them to be roughly in the same sort of condition as me. But onwards we marched and with each step that I took I was ever so close to the place where we all were going to sit down and have some lunch! Oh the Lunch!!! When I was packing it that morning, I had no idea that it was going to taste like heaven, infact, the very thought of having it at some point was practically the only thing that was still keeping me up on my legs. I took a deep breath and thought to myself, this happens to me almost everytime I go on a hike. I suffer, I endure the pain and I make promises to myself that I will never ever put my body on the line again and yet week after week I find myself with the same bunch of people up a mountain. The chain of thoughts was broken by the declaration by the group leader that we were at our destination and that it was time to rest! Its only then that I realised that this was such a nice day, a rarity in this part of the world. The sun was shining and the birds were chirpy and the view&#8230;. Well what a view! Pure bliss J I am posting a picture of it. Hope you all enjoy it just as much as I did. Though I must say the lens hasn&#8217;t done justice to the actual view that was on offer.</p>

<p>We settled down and in about 15 min with enough food and hot coffee in me, I was up on my feet and ready to enjoy the nature around me. All the thoughts of being out of breath, extremely tired etc. were a distant memory. I took a deep breath and as I was letting it out slowly, my friend said to me that I looked so happy. My face had lit up and that he couldn&#8217;t believe that I was the same guy who was huffing and puffing all the way up about 15-20 minutes back! And indeed he was right! The only feeling I had at that time was the one of pleasure. I settled down again to finish my lunch but couldn&#8217;t help thinking about the chain of events and how this happens to me almost every time I hike! Why is it that something that is so hard on my body and causes so much pain eventually ends up giving me a lot of pleasure? Why is it so important that everytime I promise myself to not do it and yet something draws me towards it?</p>
<p>I think the important question that I want to ask my readers through the medium of this blog is that most of us know what gives us pleasure and yet why is it that we end up doing things that annoy us? Most of us don&#8217;t like a 9-5 job and yet we spend years getting an &lsquo;education&#8217; that essentially is prepping us for that ( I have already written on this topic in my blog Monday <a href="http://socyberty.com/issues/monday-a-love-hate-mostly-hate-affair/" target="_blank">http://socyberty.com/issues/monday-a-love-hate-mostly-hate-affair/</a> ). This is just one phase of life, but if we look at life as whole, if feels almost every aspect of our lives has been predefinedpain ( by whom? Did they ask us? Does it please us? ). If you are a pre-teen: go to school, teen: go to high school,&nbsp; 20 something: get a job, build a career, support your parents, get married, get a house ( more like get a mortgage! ), 30 something: save for the kids, think about the future etc. I can go on and on but I think you get the point. So the question is if we didn&#8217;t set this routine ( for life!! ) and we do not get any pleasure following it, then why do we do it? More importantly should we do it?? And if we are how to change it? Also, shouldn&#8217;t any activity of ours be driven by the possibility of gaining pleasure?</p>
<p>I think a simplistic view would be to list down the activities that give us pleasure and try and follow the list! Easier said then done? Not really! The problem is not that you cant follow the list but that you have to undo all the other activities that you are doing. Yes this might even result in a &lsquo;drop in lifestyle&#8217; but sooner rather than later, you will welcome the change as being happy on the inside trumps any material outwardly happiness any day of the year. Remember you don&#8217;t live your parents life, your neighbours life, your bosses life or for that matter your dogs life and if its your life then it has to be your rules and the pleasure will be all your to have! ( I have written about Rules in life in one of my earlier blogs <a href="http://hbkhrushikesh.quazen.com/arts/rules-are-they-made-just-so-that-they-can-be-broken/" target="_blank">http://hbkhrushikesh.quazen.com/arts/rules-are-they-made-just-so-that-they-can-be-broken/</a> &nbsp;so will not expand on it here )</p>
<p>I think there is tremendous guilt associated with striving to achieve pleasure. Infact from what I hear in my day to day life, it is associated with being selfish and inward thinking. Placing me before you is not what is acceptable to the society they say. And that living life to please the others around you is a virtue that every individual must possess. Now don&#8217;t get me wrong, I am not trying to preach that you should do what pleases you at the expense of others. But at the same time, I want to ask, if you are not happy, what are the chances that you will please people around you? Isn&#8217;t this how most of us end up living our lives??? Displeased with our situation and passing the grief along as we go? ( Imagine a typical anger chain that exists in any office or house? )</p>
<p>I think hiking has changed the way I spent my weekends for the better. It started out as a trivial activity, but now is very much the poster-boy of the kind of life I envisage for myself. I have written about the joys of cooking (http://gomestic.com/cooking/cooking-2/ ) and reading books (<a href="http://socyberty.com/education/reading-books-the-lost-art/" target="_blank">http://socyberty.com/education/reading-books-the-lost-art/</a> ) &nbsp;I hope this is just a start and I will eventually reach my goal of getting out of the dreaded 9-5 lifestyle that I find myself in right now. <p>Heather Maloney of Taunton, Massachusetts, is legally blind due to <i>retinitis pigmentosa</i>, a progressive disease of the retina. She and her guide dog were refused entry at an Eyebrow Threading &amp; Henna Tattoo shop because the owner&nbsp;has harbored a fear of dogs since childhood. Maloney is a regular customer at the shop, but when she showed up there one day with her 2-year-old female German Shepherd, the shopkeeper&nbsp;said she would be allowed in only if she left her dog outside.</p>
<p>The shopkeeper says her fear of dogs stems from her having witnessed a relative in her native country undergo painful treatment for rabies after the relative was attacked by a dog.</p>
<p>A policeman who was called to investigate the incident informed the shop owner&nbsp;that she was liable for breaking the laws governing guide dogs and their masters, and that she may face civil action.</p>
<p>Maloney refused to leave her dog outside the shop, and to ease her frustration went to another store, a pastry shop, at Hart&rsquo;s Four Corners. According to her, the store employees did not seem to mind, but when she paid for her order, the cashier told her to leave her dog outside next time.</p>
<p>The tattoo shop owner, as well as the Dunkin&rsquo; Donuts staff, apparently could not see the guide dog in the same light as even the legally blind Maloney could, and so the dog&rsquo;s trainer, Mary Chapell, filed a complaint with the <a href="http://www.mass.gov/mcad/" target="_blank">Massachusetts Commission Against Discrimination</a> (MCAD) in New Bedford against the tattoo shop owner.</p>
<p>Dunkin&rsquo; Donuts corporate officials issued a statement that customers with guide dogs are always welcome at all their branches which are independently owned and operated franchises, and that their franchisees are expected to comply with all applicable state and federal laws, including the <a href="http://www.ada.gov/index.html" target="_blank">Americans with Disabilities Act</a> (ADA).</p>
<p>Chapell, a guide dog trainer for the non-profit <a href="http://www.fidelco.org/" target="_blank">Fidelco Guide Dog Foundation</a>, had spent two weeks in Taunton with Maloney teaching her to handle her dog. Chapell says that regardless of how businesses feel towards guide dogs, their refusal to allow them on their premises goes directly against state and federal law.</p>
<p>The law is on her side, so Maloney can reasonably expect to find justice in her case. If legal knowledge is lacking, business owners would benefit themselves as well as their customers by studying about the laws that pertain, to avoid similar problems in the future. It is one thing to be legally blind, and it is another to be blind to the legalities.&nbsp;</p>

			<content:encoded><![CDATA[<p>The human life has an intrinsic value, even if a person has murdered another individual. The death penalty denies the sacredness of human life. Life is so precious that nobody should ever be killed, even by the state. Killing a murderer does not bring his victim back to life. It achieves nothing but the death of still another person. I believe that a physician, as a member of a profession dedicated to preserving life when there is hope of doing so, should not be a participant in a legally authorized execution. The action of the physician can directly cause the death of the condemned, can assist, supervise, or contribute to the ability of another individual to directly cause the death of the condemned and or can cause an execution to be carried out on a condemned prisoner.</p>
<p>Physician participation in an execution can include the following actions: prescribing or administering tranquilizers and other psychotropic agents and medications that are part of the execution procedure; monitoring vital signs on site or remotely (including monitoring electrocardiograms); attending or observing an execution as a physician; and rendering of technical advice regarding execution.</p>
<p>In the cases where the method of execution is lethal injection, the following actions by the physician would also constitute physician participation in execution: selecting injection sites; starting intravenous lines as a port for a lethal injection device; prescribing, preparing, administering, or supervising injection drugs or their doses or types; inspecting, testing, or maintaining lethal injection devices; and consulting with or supervising lethal injection personnel.</p>

<p>Laws don&#8217;t always make sense. Listed below, for your edification, are a few random laws that, well, make one wonder just how far lawmakers would regulate peace and harmony.</p>
<p>In France, for example, it is illegal for the owner of a pig to call it &ldquo;Napoleon.&rdquo; Chances are, though, this law probably came about during the reign of Emperor Napoleon Bonaparte, who might have had good reason to pass this law.</p>
<p>In Thailand, it is illegal to leave one&rsquo;s house while not wearing underwear.</p>
<p>It is forbidden to bring bears to the beach in Israel. Frankly, I think it goes without saying for whatever part of the world one is in.</p>
<p>Being intelligent is a legal requirement to enter college in China. Ooo-kay.</p>
<p>No vehicle without a driver may exceed 60 miles per hour. Personally, if I saw a vehicle without a driver traveling at 60 miles per hour on the highway, I&rsquo;d call it a miracle.</p>
<p>In the grand state of New York, the penalty for jumping off a building is death. Err, what?</p>
<p>In the city of Seattle, Washington, it is illegal to carry a concealed weapon that is over six feet in length. Applies only to the likes of Yao Ming and the Big Show, I suppose.</p>
<p>All electronic games are banned in Greece. So much for Pac-Man.</p>
<p>In cleanliness-conscious Singapore, it is illegal to pee in an elevator. Given that some laws tend to be reactive in nature, i.e., passed in response to a particular need, this does say something, I suppose.</p>
<p>Kudos to Mexico, for despite all that that is going on there, they are concerned about the safety of bicycle riders, for it is illegal for the latter to lift their feet off their bicycles&rsquo; pedals.</p>
<p>I&rsquo;m sure there are a lot more laws out there which would make one scratch one&rsquo;s head. Good luck with the research, and as a parting tidbit &ndash; watch out, Scotsmen, should you go to Italy! There, you could be arrested for wearing a skirt.</p>

		<description><![CDATA[The Basics of Criminal Law which must be known to an initial level law student.]]></description>
			<content:encoded><![CDATA[<p><strong>Structure and Sources of the Principles, Doctrines and Rules in PPC:</strong></p>
<p>The criminal law in Pakistan is governed by the principles of common law which were refined in the last few centuries. These laws were imposed in the Sub-Continent by British during their rule here. When their rule ended in India and Pakistan came into being as an independent state, the existing British laws continued to be interpreted by the courts of Pakistan. It was so until the Islamization of the laws began a couple of decades ago.</p>
<p>The Islamic provisions were inserted into the law and the laws were made in accordance with the Islamic legal philosophy and basic principles of Islamic law.</p>
<p>The current criminal law in Pakistan is governed by a mixture of Islamic and western principles and doctrines.</p>
<p>The current formal structure of the Pakistan Penal Code comprises of three essential parts. These three parts are the Principles, the legal doctrines and the rules. All the three parts are dependant on each other in order to manifestly interpret the law.</p>

<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The above said three parts of the Pakistan penal code are from both Islamic and western law. And their functions are also different and each part has its own important role to play in the interpretation of law.</p>
<p>In order to understand the above said three parts, i.e. the principles, the doctrines and rules it will be of great benefit to take a look on their most common definitions and then their functions.</p>
<p><strong>The principles</strong>:</p>
<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The principles are the foundation of the criminal law or the penal code. The principles determine in the most general way, the direction and operation of the criminal law. The principles are a foundation for the whole of the penal code in general, and for the rules in particular.</p>
<p>The principles in Pakistan Penal code have been inserted from the Islamic law and also from the western law.</p>

<p>&nbsp;The principle of criminal liability: it is an example of the principles governing the criminal law in Pakistan which exist both in western and Islamic law.&nbsp; The principles of criminal liability are the principles which discuss in the widest sense, the ideas like the insanity of the defendant and duress and the participation in the crime.</p>
<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The above said principles are found both in the Islamic law and the western law. These principles alone are not sufficient to interpret the law or to determine the direction of the law in a particular case.</p>
<p><strong>The rules:</strong></p>
<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The rules are mostly defined as the narrowest part of the penal code concerning with a particular issue. The rules are commonly formed by the legislature in the form of statutory laws. And like the principles, the rules also are not sufficient enough to provide the exact and the perfect direction of law. Thus, the rules too, cannot be read or understood alone, but they have to be read and understood combined with the legal doctrines.</p>
<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The rules deal with just a particular issue and the doctrines provide the exceptions to these rules and they also have cited the special cases in which a specific rule maybe applied or exempted.</p>
<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The examples of rules in Pakistan penal code are the rules concerning particularly the intended murder, the murder by mistake and heir punishments etc.</p>
<p><strong>The Doctrines:</strong></p>
<p><strong>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </strong>Doctrines are defined as the legal theories which point out the general exceptions to the specific rules. The rules cannot be understood completely if not combined with the Doctrines.</p>
<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The doctrines in Pakistan penal code are stated in the part, named as &lsquo;General Exceptions&rsquo;. This part consists of legal doctrines both Islamic and western.</p>
<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The examples of the doctrines are those pointing out the exceptions from rules about the intended murder or murder by mistake. The rule states that intended murder of anyone is an offence and is punishable crime, but the general exception is that act done by a person bound by law is not an offence. For example; if A, a soldier, fires on a mob by the order of his superior officer, in conformity, with the commands of the law. A has committed no offence. Another example is the doctrine of right of the private defense, according to this doctrine nothing is an offence which is done in the exercise of the right of private defense.</p>
<p><strong>Conclusion: </strong>the criminal law or the penal code is like a body of laws. The principles, doctrines and rules are the parts of this body. And in order to achieve a goal, all the parts of the body have to act in accordance with each other. The same is the case with the criminal law and its above mentioned three parts. In order to fulfill the aim of the law , one has to understand all the three parts t a time, because they give the real meaning when they are combined and they are not sufficient individually to determine the aim of law.</p>

<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; All the three parts of the penal code have their own significance, and it is necessary to keep in mind the general function of each and every part when dealing with it, for example while dealing with a principle it must be known to the reader that the principle concerns with the most generalized ideas, thus the reader will be able to understand the aim of the principles more easily. And when dealing with the doctrines it must be known to the reader that these are the special circumstances or the exceptions and similarly the rules must be known to the reader in their real narrower nature.</p>
