			<content:encoded><![CDATA[<p>Simply put a living trust is a trust that you create while you a still living, rather than one created at your death.&nbsp; A living trust allows a person, called a trustee, to hold title or ownership to your property and assets.&nbsp; You can be trustee of your own living trust or assign another individual the role of trustee.&nbsp; A living trust is a lot like a will in that it gives instructions and details of how to handle your estate at your death.&nbsp; The difference between the two is that a living trust does not go through probate, consequently preventing the court system from controlling your assets while a Will does have to go through probate and your assets will be controlled by the courts at your incapacity.</p>

<p>There are 4 parties involved in a living trust:</p>

<p>&middot;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <strong>Trustee:</strong> This is the person named by the trust as the controller of the assets.&nbsp; In most cases the trustee is usually the same individual as the grantor while the grantor is still alive.&nbsp; A trustee can also be another individual or institution to manage your trust.&nbsp; There can also be more than one trustee at a time known as co-trustees.</p>
<p>&middot;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <strong>Successor Trustee:</strong> This is the person you give the right to control the trust should the trustee die or become incapacitated.&nbsp; The successor trustee only has the right to distribute the trust according to the grantor&rsquo;s instructions as stated in the trust agreement but does not have the right to modify the trust because the trust becomes unchangeable upon the death of the grantor.</p>
<p>&middot;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <strong>Beneficiary:</strong> This is who you name to receive the benefit of the trust.&nbsp; Anyone can be named as a beneficiary including charitable organizations and other institutions.</p>
<p>There are two steps to creating a living trust.&nbsp; The first step involves the preparation by an attorney of a legal document called a &ldquo;trust agreement&rdquo; this is the document that sets the terms and conditions of the trust including the naming of the trustees and beneficiaries, and when and how the trust should be distributed.&nbsp; The second step involves the grantor transferring the assets (home, investments) to the trustee who holds them for the benefit of the named beneficiary.&nbsp;&nbsp; Although the assets are now owned by the trust at this point you still retain the right to use and enjoy your property.&nbsp; Also important to note is that a grantor can make changes to the trust at any point during their lifetime.</p>

<p>English law recognizes many different capacities in which a man may act. Often he has power to do an act in an official or representative capacity when he would have no power to do the act in his private capacity or on his own account. All sorts of difficult questions arise out of these distinctions, for instance, whether a person on a particular occasion was acting as trustee for fund A or as trustee for fund B; whether a director has the powers and duties of a trustee; whether an executor has turned into a trustee, and so on.&nbsp; A man has two or more capacities does not give him the, power to enter into a legal transaction with himself. Double capacity does not connote double personality. For instance, at common law a man could not sue himself, or contract with himself, or convey property to himself, and it made no difference that he was acting on each side in a different capacity. So rigorous was the rule that, if the same party appeared on both sides of a contract, even though accompanied by different parties in each case, the whole contract was void. In many cases the rule worked hardship, and its consequences had to be mitigated. For instance, where a creditor became his debtor&#8217;s executor, the rule that he could not sue himself, for the debt was mitigated by giving him a right of retainer. By statute, where a person purports to contract with himself and others, the contract is enforceable as if it had been entered into with the other persons alone. Also, by a historical accident, namely, the effect given to the Statute of Uses, it became possible for a man to convey to himself; and this power, which was found to be useful however theoretically anomalous, is preserved in the modern legislation that repeals the Statute of Uses. With these and other small exceptions, the ruler that a person cannot enter into a legal transaction with himself remains unimpaired.</p>

<p>A Will allows a person (called&nbsp;the &#8220;Testator&#8221;) to make provision for the administration and distribution of his possessions (&#8221;his estate&#8221;) among his family, relatives, friends or favourite charity (called the &#8220;beneficiaries&#8221;) after he dies.&nbsp; Beneficiaries are the ones who inherit or benefit under the Will and they can&nbsp;be anyone, even his pet.</p>
<p>The Testator will nominate a person (called the &#8220;Executor&#8221;) to carry out the administration and distribution of his estate upon his death. Usually, this person is appointed as both the executor and the trustee. A trustee is person who has been empowered by the Testator to&nbsp;hold his estate upon his death.</p>
<p>It is also worthwhile to note that is always preferable to name two or more Executors/Trustees if you are naming minors as beneficiaries in your Will. These Executors/Trustees&nbsp;who would be able to administer or hold any assets or invest or use any money for the benefit of these minors. In Singapore, minors refer to persons who under the age of 21 years.</p>
<h3>Who Should Prepare a Will?<br /></h3>
<p>Well, usually anyone who has assets should have a legally valid Will. This will help&nbsp;to ensure that your wishes are carried out after your death.</p>
<p>If you do not have a Will when you pass away, your assets will be distributed according to the rules of intestacy as laid down in the Intestate Succession Act and&nbsp;your estate may be distributed to people who you do not intend to give anything to.</p>
<h3>Who Can Prepare a Will?<br /></h3>
<p>You can prepare a Will if&nbsp;you are of legal age and of sound mind and you can change it anytime&nbsp;during your lifetime without consulting a lawyer.&nbsp;However, there is a risk that a&nbsp;Will&nbsp;prepared by yourself&nbsp;may be ineffective or invalid due to some legalities, which may cause your beneficiaries to suffer unnecessary expense or delay in the execution of your Will. It is therefore advisable to consult a lawyer&nbsp;in respect of&nbsp;the preparation of your Will.</p>
<h3>What Can You Give Away in Your Will?<br /></h3>
<p>You may give away your property, vehicle, shares, insurance policies, money in your bank accounts, cash and jewellery,&nbsp;i.e. anything that you own.</p>
<h3>What&nbsp;are the Information you Will Require&nbsp;in Your Will?<br /></h3>
<ol>
<li>Name, identification number and address&nbsp;of your Executor / Trustee</li>
<li>Names, identification numbers and addresses&nbsp;of your Beneficiaries (if they are not your immediate family).</li>
<li>Name, identification number and address of a Guardian if you have minor children. You may want to appoint someone who would be responsible for their care.</li>
<li>Names, identification numbers and addresses of at least two Witnesses</li>
<li>You will need at least the signatures of two adult witnesses for the Will to be valid. Do keep in mind that witnesses must not be beneficiaries under the Will. The husband or wife of any of the beneficiaries cannot also be a witness of the Will.</li>
<li>Details of your assets</li>
</ol>
<h3>To Prepare a Will<br /></h3>
<p>Below is an example of a&nbsp;simple Will:</p>
<p>Title:&nbsp; <strong>WILL OF [YOUR NAME]</strong></p>
<p>I, [your name], residing in [your address], of [your identification number], being of lawful age and sound mind and memory, revoke all my former Wills and Codicils and declare that this is my Will.</p>
<p>I appoint [name of your Executor / Trustee], of [your Executor's / Trustee's identification number], of [your Executor's / Trustee's address] to be&nbsp;my Executor and Trustee of my Will (hereinafter referred to as my Executor). My Executor shall pay my just debts, estate duties, legal and funeral and testamentary expense out of my estate.</p>
<p>I give, bequeath and devise all my real and personal property over which I may have a general power of appointment or disposition by will and including but not limited to:</p>

<h3>Things to Remember<br /></h3>
<p>You should review your&nbsp;Will from time to time and change it if</p>

<p>2.&nbsp;&nbsp;&nbsp;If you married (assuming that you were not married at the time you signed your Will);</p>
<p>3.&nbsp;&nbsp; If you remarried;</p>
<p>4.&nbsp;&nbsp; Anyone mentioned in your Will changes his name;</p>
<p>5.&nbsp;&nbsp; If a beneficiary dies;</p>
<p>6.&nbsp;&nbsp; If you no longer own the assets mentioned in your Will or you acquire new assets that need to be mentioned; and</p>
<p>7.&nbsp;&nbsp; If the executor or trustee dies or is unable to carry out his duties due to ill-health.</p>
<p>You should also let your family and Executor know that you have a Will and&nbsp;where you kept.</p>
