...no need to run around with a gun all the time ...

The Second Amendment isn’t an absolute right, in my opinion. Rights, generally speaking, are not absolute.

Guns should be kept at home. I don’t see any need to run around with a gun all the time.

It’s true. Absolute rights are simple. Absolute Free Speech means anyone can say anything, anywhere, anytime… An absolute Right to Bear Arms means people can bear any arm, anytime, anywhere… Neither idea is workable, in my opinion.

Some things are so basic they’ve never been recorded as rights, as best I can tell. The Right to Breathe isn’t recorded in the U.S. Constitution. I suppose that’s an absolute right. It’s also an unrecorded right.

The best policy in my opinion is to keep guns home.

The Right to Free Speech is not absolute. It’s easy to think of a facetious example. A person cannot poison a drink, offer it to another, and say “It’s OK. Have a drink.” It’s no defense to say “I was exercising my Right to Free Speech when I made the statement, It’s OK. Have a drink.”

The Right to Bear Arms is similar. It isn’t absolute. I have no Right-to-Fire-A-Cannon-Anytime-I-Choose.

It's really true that many Americans are unaware or never read their own US constitution. Year by year, Americans are being set up by their very own establishment to give up their rights. The same rights they inherited from their forefathers who fought with their blood, sweat and tears.

It’s pretty sad to see that many Americans are being manipulated by their elite and their mainstream media. They do not see how they are being set up as sheep ready for slaughter. The US Constitution is primarily set up to protect US citizens from their government by giving them special rights called the Bill of Rights. Rather than explain what the US Constitution is all about(you can check Wikipedia), I shall just present to you what amendments or rights US citizens have already lost or about to lose in the next few months.

The Bill of Rights, the first ten amendments to the United States Constitution Česky:(Photo credit: Wikipedia)

The First Amendment: In a nutshell it is about freedom of speech, freedom of religion, rights to peacefully assemble and rights to petition the government. (This right is in jeopardy)

The Second Amendment: Gives an individual the right to possess firearms to keep at home for self-defense. (This right is in jeopardy)

<strike>The Third Amendment: </strike> Protects US citizens homes from being searched by soldiers during peacetime without the owner’s consent. Only in wartime it is permissible but only according to law. (This right has been lost.)

<strike>The Fourth Amendment:</strike> Protects US citizens from searches and seizures. All searches requires a warrant from the court judge and is to be conducted by a law enforcement officer. (Lost)

<strike>The Fifth Amendment:</strike> Protects US citizens against abuse of government authority in a legal procedure. No one shall be held accountable for a crime unless indicted by a grand jury. (Lost)

<strike>The Sixth Amendment: </strike>This is rights in criminal prosecution. The accused will have the rights to have an impartial jury and a speedy trial. He has the right to defend himself by having witnesses in his favor, have the nature of the crime presented to him and get Assistance of Counsel for his defence. (Lost)

Acts and Cases that Cancels Out The Bill of Rights

The Patriot Act: The Patriot Act cancels out the Third Amendment in the Bill of Rights. This Act was signed into law by President George Bush on October 26, 2001 to allow law enforcement agencies to gather intelligence. Law enforcement officers can search a home or business without the owner’s or the occupant’s permission or knowledge. This act also expanded the definition of terrorism to domestic terrorism. Barrack Obama extended the Patriot Act another four years after coming into office after promising the American people that he would uphold the US constitution.

The NDAA: The NDAA cancels out the Fourth, Fifth and Sixth Amendments. The National Defence Authorization Act(Martial Law Act) was signed into law by president Barrack Obama on the eve of the year 2012. This act has a very wide spectrum from national security programs, Department of Defense health care costs, counter-terrorism within the U.S. and abroad, and military modernization. US citizens can now be placed under indefinite detention without any prior indictments by the military. No trial, rights or reasons are to be given under this act. The first US citizen to get killed by this act is Anwar al-Awlaki.

TSA: (Transportation Security Administration) TSA screenings at airports cancels out the fourth amendment. US citizens are subjected to nude body screenings or uncomfortable body pat downs by TSA agents. Watch TSA pulls down pants of amputee.

Trayvon Martin Case: President Barrack Obama had jumped into the fray by saying that Trayvon Martin could be the son that he never had. This is just a ploy to solidify the case against the right to possess firearms. The mainstream media had also unjustly sensationalised the case by continuously putting up photos of a 14 year old Martin who looked like an angel instead of putting up the real 17-year old and 6 foot 3 inches photos of the teenager who jumped onto George Zimmerman. Martin was later shot and killed by Zimmerman. NBC also later fired their producer for editing the 911 voice recordings of Zimmerman to make him look like he was in the wrong. The Trayvon Martin case is definitely being set up to cancel out the Second Amendment. The Stand Your Ground law is now being debated amongst the public at the moment. In the court of public opinion, Zimmerman had already been found guilty even before he is being put on trial. If the American people wi-sens up quickly, the movement to remove the Second Amendment would fail.

SOPA(Stop Online Piracy Act) : This act gives the ability to U.S. law enforcement to fight online trafficking in copyrighted intellectual property and counterfeit goods. At least under the guise of that. This Act was killed before it could be signed into law by the Obama administration because the internet community discovered it and took action quickly by pressuring their Congressmen to reject the Act. It was a concerted effort from many individuals and organizations. This bill was supposed to cancel out part of the First Amendment (free speech & free flow of information)when it comes to the internet. In the mean time however, another similar Act is being drafted by the Senate. Though this act did not succeed, the Kiwi owner of Megaupload was extradited and still charged in the US.

The elite establishment tactics of fear mongering and of divide and conquer, had tricked many Americans into giving up their rights easily. Rights that many in the past had fought and died for. Well, what are you waiting for? It’s time to read the US constitution before the United States is no longer the home of the free and the land of the brave.

Failures in our system are our responsibility to fix.

No where in the Constitution does it say that the Commonwealths are a socialist entity. The Commonwealths cannot make up laws or not enforce laws that are guaranteed under the US Constitution. Let’s talk about the fact that the people looking for work can not even be protected from Job scammers from a state job site. This is a site that should be free from the burden of predators preying on the people looking for work. For the record just because a state job site says beware of scams does not alleviate them from the responsibility of due diligence they are required to perform for the safety of their constituents.

Next we will talk about their failed education system. They are trying to say it is unconstitutional for cameras in a school. WAIT! The law specifically says as long as there is no reasonable expectation of privacy recording devices of any kind is legal. That means cameras is a must.

Bullies are allowed to trample people with no evidence to the contrary, well this is not happening. I am urging citizens to use the system and get all the documentation. If you had dealings with the principal of Scott Middle School specifically its OK we can get him fired really easy. Pressure is a political nightmare.

Are the words of the late George Carlin correct? Here is what he said,” There is a reason that our education system sucks in this country, and its not going to get any better, so be happy with what you got. Cause the Owners of this country don’t want that, I’m talking about the real owners now.”

Is he right? Is there proof he’s not? I don’t think so every year in Virginia especially the educators and administration get dumber and dumber and that means our children are not getting the best cause they are not the best. Take a stand and get these people to do their jobs. It’s up to us to make these people do their jobs and make our country a better place.

Our founding fathers knew the difference between freedom and tyranny but many Americans are either too apathetic or too oblivious to the lessons of history to know the difference. That is exactly what tyranny needs to succeed, men who will do nothing as they watch it grow and take control of their nation.

Reflecting on the fate of my beloved country as you should be doing too, I never cease to be amazed at the level of ambivalence that the Democrats have for the US Constitution. I think all citizens here in our country should note their enemy and what fuels their passion for wresting control of the nation from all who value limited government, fiscal responsibility, and individual freedom. I know these concepts seem a bit blurred to some of you since they’ve been thrown around quite a bit in the media, and you’ve heard many people arguing over these beliefs.

It is important for all of us to realize that there are universal truths that transcend the relevance of time. Our forefathers, the authors of the Declaration of Independence, the US Constitution, and the Bill of Rights designed these guidelines as a result of first hand experience with tyranny. That tyranny resulted from King George’s government of Great Britain. The citizens of the 13 colonies felt the full pressure of big invasive government, taxation with representation, and over regulation. These people were well acquainted with oppression. They knew the face of the enemy.

That enemy looked like them, claimed to hold the same beliefs, and expressed that they had the best interests of the citizens in mind, but that was far from being true. The Royal Crown had absolutely no intention of allowing personal freedoms, reasonable taxation, or restraining government influence in society and private business. There were loyalists, those who sided with the British, and there were true Americans who wanted independence, freedom from big government, and the right to seek personal happiness.

As much as King George resented granting freedom to the 13 Colonies, he was advised by his legal staff that the colonists were well within their legal rights and well represented by their lawyers. In fact, King George’s government, on the verge of declaring war upon the 13 Colonies in order to maintain control over them, gave the colonists more respect than the Obama Administration gave our Constitution as well as the people of the US over the last 20 months.

Obama’s assault on American heritage and everything it implies has been relentless, deceptive, and intent upon dissolving all free enterprise, free will among the people, and their collective sense of independence. This Obama has done by building a gigantic government bureaucracy with a runaway budget deficit, that solves every crisis by promoting dependency upon federal leverage and the unnecessary expenditures that come with it.

Does the past reflect itself upon today’s events? Surely you can see the parallel. Everything that our forefathers foresaw when they ingeniously contrived the great documents of independence and freedom is now being proclaimed as obsolete and subject to reinterpretation by such progressives as Cass Sunstein, one of Obama’s appointed Czars. This Harvard professor thinks that the US Constitution is a product of another time and a different political atmosphere, but that is typical of those who want to control the masses. Managing people and their lives like a herd of cattle is exactly what liberals, socialists, and progressives have been advocating ever since the birth of our nation. They have presented themselves in several incarnations over the decades such as the Federal Reserve, Communists, Fascists, Labor Unions, Progressive Educators, and all the other charlatans who seek to undermine our republic.

What do we now share in common with our ancestors who had the audacity to resist the most powerful army on the face of the earth commanded by the most power hungry monarch in the western world? My fellow countrymen, our entire way of life is at stake. Those who cannot stand the concept of individual liberties, who hate the idea of a society unhindered by big government, who feel that all aspects of people’s lives must be regulated, are mindlessly at work. Fueled by the flawed vision of Marxism, and the intellectualized rationalization of modern progressives who consider themselves above such outdated beliefs as God and moral absolutes, the disinformation continues.

Like termites they continually advance their dialectic of social enslavement beneath an omnipotent state that crushes individual creativity and ambition. As everyone submits to never ending authority, as a result of the unrelenting indoctrination in public school systems, by our mass media who repeats everything dictated to it by the federal government, we find that our freedom of choice is evaporating. Americans who have become complacent and have neglected their responsibility to monitor government and vote, have slept at the wheel for too long and allowed liars to corrupt our great system. We have trusted the opportunists and power mongers to oversee our beloved country as we went about our self centered preoccupations.

There is an old saying, “ in order to become your master you were first approached by a servant.” Do entitlement programs such as Welfare, Medicaid, Stimulus Bills, and Immigration Amnesty not promote dependence and unaccountable behavior? For everything the government says that it grants or gives to one faction, they tax and remove from another segment of society. Those who work hard and exercise ambition will inevitably be victimized by the false equality forced upon the masses by a liberal government.

Just as in the early days of the fledgling republic called The United States of America, we now find ourselves at a historic crossroads that cannot be ignored. Whether our aspirations of preserving the ideals of our forefathers so that our republic survives modern indifference or crumbles under selfish and demanding abuses of a liberal illusion is up to us. We were warned long ago by Thomas Jefferson. “The price of freedom is eternal vigilance,” our third President of the nation cautioned. How sad it is that so many have rendered themselves deaf to those words of wisdom. The fate of America is now in our hands.

Compares and contrasts rule of law with rule of men.

Rule of law is a concept where the law is the supreme rule. The government and the people under that government are all under the rule of law. A government under the rule of law is subject and bound by its constitution. Contrary, a rule of men is a society where one or few rule arbitrarily. The government is not subject to law; rather the law is subject to the government. A constitution tries to establish the rule of law by creating a government that has restrictions on it. It also does it by making very general laws that need to be interpreted by a separate judiciary. The term for making a fundamental law that sets up and controls a government is “constitutionalism.”

Your no doubt aware of my article on "the Constitution: it does matter." Well here's another one of my rants about the Constitution mattering more than politics.

Image via Wikipedia

What makes a person a traitor? Is it defying the country? Raising arms against the government? Is it someone who betrays the principles of their countries founding fathers? or is it people who make a claim that defending the government and not the principles, is loyalty? I ask you the reader: what do you consider an act of treason?

To me an act of treason is when the leaders and it’s followers abandon reason and common sense to promote their best interests.

What Emperor Bush, his servant Darth Cheney and War Minister Rumsfeld is such an act. They went ahead with the invasion of Iraq with Congressional approval and those that voted for them considered it UN-American not to attack Iraq.

What do they know of being an American when they haven’t read the constitution?

If they had read the Constitution, they would know that Article One, Section Eight of the constitution clearly says that Congress has the power to declare war, not the office of the President.

Yet ever since Emperor Bush and Darth Cheney’s ascension to the throne, they have chosen not to go to congress for any approval and those in congress choose not to defy them out of loyalty to the party. Even with Bush and Cheney out of office, the office of the President continues to disregard the constitution not just when it comes to war, but civil liberties.

Even after 9/11 and controversy of Abu Ghraib, their still is no regard for the 8th and 4th amendment, both have been disregarded in the so-called “war on terror” and “national security”. We’ve seen through the lies and we know for a fact that what Congress, the Senate, the House and the office of the President are ones who have committed acts of treason against the United States and it’s people.

So I ask you, the reader again: What is treason?

The Justice Department hides Government's socialized healthcare agenda behind the Constitution.

The US government is trying to force Americans into paying taxes for NOT buying one of Obama’s Socialist Healthcare schemes (if such becomes a reality). This is one of many government attempts to enforce Socialism, a despotic ideology that fundamentally contradicts the essence of the US Constitution.

In his article, “Government appeals judge’s health care ruling”, Greg Bluestein reported that the US government is trying to support Obama’s Socialist Healthcare agenda by appealing a ruling that negated the healthcare scheme.

According to Bluestein, the Justice Department (JD) defended the government’s plan to penalize people through taxes for NOT purchasing socialized health care. The JD stated falsely that this is “constitutional” because Congress can regulate interstate commerce.

In actuality, this is a half-truth based on a serious oversight about the US Constitution. The JD overlooks that the Constitution’s fundamental purpose is to ensure government protects the people’s individual rights from being violated—by either street criminals or government workers who abuse their power.

Although the Constitution does allow for some federal regulation of interstate commerce, it is not at the expense of individual rights. That is because the US Constitution is fundamentally based on the supremacy of individual rights—which conditions every other stipulation in the Founding documents. That means any application of the “commerce” stipulation has to be consistent with the protection of individual rights.

Assuming for the sake of argument that “regulating interstate commerce” accurately describes the forcing of citizens’ into buying socialized healthcare, the “commerce” clause will only violate individual rights. What is violated, in this case, is a citizen’s right to make his own judgment call in determining if he needs a healthcare policy or which one to buy. Because of its violation of this right, the “commerce” clause does not constitutionally apply to the buying of socialized health policies.

In reality, “regulating interstate commerce” does not accurately apply to forcing citizens into buying (or selling) any kind of policy—as the JD would have you believe. Instead, the federal regulation of interstate commerce only refers to regulating the actual transportation of goods. This results from a business deal that both parties have already voluntarily agreed to. But when we discuss government coercing both sides into the business agreement in the first place, that is different. Now, we are discussing the coercion of employer and “healthcare buyer” into an involuntary business deal (not the regulation of the commerce that results).

Coercing purchase of socialized healthcare gives rise to the deeper issue of the injustice of governmental force against law-abiding citizens. Because the government can imprison us without our consent, it’s enforcement of constitutional or unconstitutional laws is coercive. When our government coerces law-abiding citizens into buying socialized healthcare, it unjustly violates the right of people to make personal choices regarding their own health. This right to make personal decisions about one’s health results from the “…right to life…liberty…” mentioned in the Declaration of Independence.

Further, the ONLY justification for government coercion is to forcibly prevent thugs from violating our individual rights. This protection of rights is the government’s prime Constitutional purpose.

In essence, government coercion of citizens (not criminals) is the same act as a thug on the street pointing a gun at you and forcing you to do things you do not want to do. Whether committed by government or by street thugs, the victim’s rights are violated.

Because of the potential violation of our rights, we must make our representatives realize that government officials do not have a right to decide for us if we should buy a (socialized) health care policy. People’s health considerations relate SOLELY to individual citizens and the government does not own their bodies. Consequently, only individual citizens, not legislators, have a right to decide if they will buy health care policies.

The attempt by government to “force-feed” citizens socialized healthcare proves that there are officials who have no respect for our individual rights and a zero understanding of the US Constitution. Hence, our officials are hypocrites for attempting adoption of Socialist policies while being responsible for upholding the US Constitution.

This hypocrisy of forcing Socialist healthcare on people motivates the majority of Americans to join the Tea Parties. Only time will tell if Americans are going to make successful political efforts to stop our government from contradicting our constitutional rights.

While doing my research for another completely unrelated article to this one I found some information that I could just not believe to be true. I was so surprised I had to contact a friend of mine directly in the USA to clarify that I had not missed something.

The United States is sometimes accused of being a little heavy handed in the way it polices some parts of the rest of the world and is often quick to state how other countries should behave or toe the line, some of these types of incidents have even happened in the last few days, or weeks.

So imagine my surprise this morning when I read of a proposed amendment to the United States Constitution that was originally written in 1923 and was not passed to the US Congress until 1972. To give the US Congress their due they did allow it to pass both houses but it failed to gain its ratification in time and the deadline of June 30th 1982 passed so the proposal was dropped.

I thought to my self well surely in the almost 30 years since this has passed it would have gone through again and in this day and age of all things being equal it would have passed by now. Well, I was wrong it has not gone through and so what could it be that is taking so long to get passed into being a part of the US Constitution?

It is Equal Rights for Women, how I ask can a country as forward thinking as the good old US of A not give equality to about 50% of its population?

In 1979 at the General Assembly of the United Nations the ‘Convention on the Elimination of all forms of Discrimination against Women’, otherwise known as CEDAW was adopted and this international bill of rights for women came into being on the 3rd of September 1981. Of the 192 member states of the United Nations only seven have not signed it. They are Nauru, Palau, Somalia, Iran, Tonga, Sudan and the United States.
