Aircraft type F/A-18D Hornet Fall, The plane crashed around 12:05 am local time, just moments after takeoff from Oceana Navy Air Base, located less than 3.2 miles from Mayfair Mews apartment complex where the plane went down. Witnesses said the saw the fire come out from the bottom of the right wing of the plane before it crashed.

The crash has so far only nine known to cause minor injuries, including two pilots who had to enable the chair thrower before falling. One pilot was found still attached to the chair thrower and his parachute in the middle of the ruins of the apartment.

Locals immediately transport the pilot is away from the fire bigger. “The pilot apologized for bumping our apartment,” said Pat Kavanaugh, one of the residents who participated in handy.

Oceana air base has a runway long as more than seven miles (10 kilometers) and a pilot training center of the U.S. Navy and U.S. Marine Corps (USMC). The base is located not far from the main base for the U.S. Navy Atlantic Fleet in Norfolk, Virginia.

In personal injury law, the term negligence is used to indicate that someone failed to exercise the proper care in a particular situation. When used as a legal term, the word negligence had a particular definition with specific elements. In order for an injured party to collect damages from the negligent party, they must establish proof of each element.

When determining negligence, the first element that must be established is a Duty of Care. The injured party must show that the other party had a legal duty to exercise a level of care under the circumstances. For instance, in car accident cases, all drivers are charged with the duty to obey traffic laws. In addition, they have a general duty to keep a proper lookout and not intentionally cause an accident. For instance, if a driver sees a potential hazard, they may not ignore the hazard just because the law indicates they have right of way. If a driver is on a highway approaching a green light, they have the duty to not plow into vehicle stalled in an intersection.

The second element of negligence is to determine whether there was a Breach of Duty. Once a legal duty of care has been established, a plaintiff must show that the defendant failed to honor that duty. Generally, this is proved by showing the defendant knew, or should have known, that their actions would have resulted in the consequences that followed. In car accident cases, a driver knows, or should know, that following another care too closely might result in a rear end collision. Thus, if that driver fails to keep a proper distance from the car they are following crashes into it, they have breached their duty to maintain a safe following distance.

An injured party must next establish that the breach of a legal duty of care was the Cause of their injuries. Keeping with the car accident example, a plaintiff would have to show their particular injury, e.g., whiplash, was caused because the defendant ran a red light and crashed into their car. In some instances, a particular injury or ailment may be attributable to several negligent acts. In a famous case in 1902, two campfires were left burning which led a forest fire and to the plaintiff’s house being burned down. The case decided that both defendants’ negligent actions equally caused the plaintiff’s losses.

Finally, the plaintiff must establish a real injury or Harm for which he is legally entitled to collect damages. Most cases involving physical injury or harm are actionable. Some cases where there is emotional harm only there is no right to compensation. A parent whose child is injured in a car accident cannot make a claim for emotional damage based on them having to cope with the horror of their child’s injury.

Once the plaintiff has met their burden of establishing negligence based on the four factors above, they may collect damages. Damages are generally classified as special, general or punitive. Special damages are those that are quantifiable, such as medical bills, loss of earnings, damaged property. General damages are those that are intangible such as pain and suffering, loss of quality of life, loss of consortium. Punitive damages are those meant to punish the plaintiff for their actions, for instance injuries resulting from a drunk driver.

The general definition is fairly standard in all jurisdictions; however, some areas apply it differently depending on the circumstances. Be sure to consult with a personal injury lawyer if you think you have been the victim of someone else’s negligence.

The criminal law statutes are divided into two categories: those classified as a felony and those classified as a misdemeanor. Misdemeanors are minor offenses such as trespassing, disturbing the peace, underage alcohol possession, and some traffic offenses such as DUI. Some offenses can be charged as either a felony or misdemeanor depending on their severity. Examples include assault and battery, larceny, destruction of property, and some drug possession charges.

Housing: Rental companies ask for a criminal history of potential tenants and may deny housing to ones with misdemeanor convictions.

Immigration/citizenship status: People who are seeking U.S. citizenship, or those in the U.S. for employment, will be screened for possible deportation, may have their VISA revoked, or may be denied citizenship if convicted of a misdemeanor.

Community activities: Many civic organizations, such as little leagues and scouting groups, will not accept parents and other volunteers who want to participate if they have a misdemeanor conviction on their record.

Firearm possession: Some misdemeanor convictions, such as domestic assault or firearm charges, will have an effect on future firearm permits and licensing. Federal forms required for firearm purchases routinely inquire about these offenses and may be a disqualification for purchase.

The list above is not an exclusive list. Surely there are other local or regional effects to which others may be subject. Two female officers into the United States Navy same-sex couples who perform traditional rituals “first kiss” in the dock since the U.S. end the ban on gays to be a soldier.

Marissa sergeant Gaeta, who just got off the ship after 80 days, win the lottery to be the first to give a kiss on her partner or known as the “Dockside kiss.”

The couple said the moment was “long awaited.”

Policy of “Do not Ask Do not Tell” repealed the U.S. armed forces last September, after a debate over the years.

That policy prevents men and women who admitted frankly that they are gay to serve in the military.

The couple who met while training it to say happy because it could be open about their relationship.

“It feels good to be myself. This moment I had been waiting for,” the sergeant said Gaeta.

Snell said the corporal had told their partners about the kiss was a few days ago and he was “nervous but excited.”

“I’m a little nervous … But I have long waited for this moment since he left,” said Snell.

A Navy spokesman speaking to Reuters news agency that the military is “not too concerned things like that” but he was sure this was the first time the traditional kiss by lesbian couples.

“For the Navy, it was just a regular welcome,” said the lieutenant Sylvia Landis.

Individuals often want the opposite of what they have learned to accept as the norm. So when they are put in situations where they have to reach across socio-economic and racial lines as part of what they do there is a tendency to prefer to seek out situations where individuals of another race or socio-economic status are not going to be around. I’ve heard that self-segregation is more of an issue in the North than it is the South. I am not sure if that is necessarily the truth or not but I have noticed being in the Virginia Beach region of the South individuals seem to be more willing to reach across the line and are not as exclusionary as they are back in Ohio. Back home people may reach across the line because you are in the same socio-economic “station in life” as they are in, but they would do so begrudgingly. People did not really want to play nice, but they would because it was the right thing to do.

Now that puts me in a weird predicament, because I talk a good game but at the end of the day I still am not comfortable with it myself. Granted I have been here for three years, but there is still that part of me that is narcissistic and pessimistic that is looking for the worst to come out of a situation that rarely manifests itself in that way. People say that the suburban and exurban areas of Virginia Beach and Chesapeake are racist; but my experiences suggest otherwise. On the contrary, these are cities that do not have the exposure to African-Americans that the other areas do. Though Chesapeake has a slum that it took from Norfolk that area seems to be more harmonious than others because people are in the same boat.

The last time I went back to Ohio it seemed as though things had changed a bit. The mentality and that unspoken, under the radar type of institutionalized racism I had experienced growing up does not seem to have been as profound as it was there. Of course I was in the Northern part of the state, and I remembered how overt the indifference was in the Southern part of Ohio. But I am still convinced that a lot of what you experience in Ohio, is that there is a general lack of diversity overall.

So I ask myself again how anyone can complain about racism when they are obviously more comfortable around their own. We live in an age where people are indifferent about racism. They do not support it, but they do not do anything to combat it either. They say that they have friends of other races and date people of other races but they feel more comfortable among their own race. They deal with people of other races that fit convenient stereotypes of what attracts them to someone of another race. They deal with those people that are going to play nice, as opposed to those stuck in the misanthropy and narcissism of mankind.

I am not speaking about Whites that have token Blacks around but also my own people that have narrow views of what people of other cultures and races are like as well. We want to see what we want to see, we do not want to take into context the full scope and breadth of what you may find and we do not want to see people for the individuals that they truly are. It is like if I get up and say that I like rock music or techno and you ask me about it and I talk about commercial artists. I am not that deep into it and should not come across as though I am, but I am curious so I deal with what is safe. I do not get as deep into your culture as I could, and you don’t try to pull me in any deeper than where I am willing to tread.

There is a lot that we can learn from each other. But if we continue to go out of our way to stay amongst our own we will never truly learn anything from that other individual. We like to stay in our comfort zone, as much as we preach that this is 2010 it still feels like 1980 …
