Unions and Their Effect on Business Legal Environment

In the situations where employer feels like being screwed upon, he cannot sue the recruiter nor the company that hired him. Globalization pressures motivate unions to factor new concerns into their bargaining and organizing approach. Union derives the power to inflict damages on the firm through labour withdrawal and thereby enforce changes in the rules and regulations of the firm.

            Nowadays it is common for recruiters to overstate the qualities of a position. A job described as a top chaired post may end as something working under a supervisor. Sometimes a job publicized as least accepted job may be much above the expectations. In the situations where employer feels like being screwed upon, he cannot sue the recruiter nor the company that hired him.   Globalization pressures motivate unions to factor new concerns into their bargaining and organizing approach.

            The standard view of the unions is that they are organizations whose purpose is to improve the material welfare of members, principally by raising wages. Unions have mainly been content to articulate the material demands of the members’ bigger share of wealth produced by capitalist system and protect their jobs. Unions were formed, organized, financed by the members for their own interest. Unions are both social and economic organizations that arose out of the need to improve bargaining power of individual workers through collective action. Unions play innumerable roles which include defending the employer’s rights, resolving the conflict between employers and company, providing some extra benefits to the members, etc. Such unions have a significant impact on the compensation and work environment of both unionized and non-unionized workers. The effects of the unions depend on the structure of firms product market, whether competitive or monopsony. Union has been shown as significant social force at a similar stage of industrialization of different countries, the structures and forms which emergent labour took have been seen to differ widely.(Mike Rigby, et.al., 1999) Business society on the other side identifies their interest with success of enterprise. In the process of doing good to the workers category, the unions go ahead to such an extent that makes life difficult for the business to survive by way of restrictive practices.(Trevor Marshall, 2000) Union derives the power to inflict damages on the firm through labour withdrawal and thereby enforce changes in the rules and regulations of the firm.

The legal environment consists of law which refers to a code of conduct that defines the behavioral boundaries for business activity. As per the Justinian’s Institutes, a summary of Roman law published in 533 in Constantinopole, “the commandments of the law are to live honorably, harm nobody, give everyone his due.” (Roger E. Meiners, et.al., 2005)          Business enterprises are obliged with providing best facilities at the workplace, right pay, etc. to the employees.
